88 AN ACT
99 relating to emergency generators or other power sources for nursing
1010 facilities and assisted living facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 242, Health and Safety
1313 Code, is amended by adding Sections 242.053 and 242.054 to read as
1414 follows:
1515 Sec. 242.053. EMERGENCY GENERATOR OR OTHER POWER SOURCE.
1616 (a) Each nursing facility licensed under this chapter shall ensure
1717 the facility is equipped with an operational emergency generator or
1818 comparable emergency power source and a sufficient amount of fuel
1919 to operate the generator or power source during a power outage for a
2020 minimum of 72 hours in:
2121 (1) an area in the facility of sufficient size to at
2222 all times safely maintain residents as appropriate for resident
2323 needs; and
2424 (2) for a facility that maintains an installed unit
2525 locking device, as defined by commission rule, to restrict a
2626 resident's ability to exit a unit of the facility or the facility, a
2727 separately powered area in addition to an area described by
2828 Subdivision (1).
2929 (b) An operational emergency generator or comparable
3030 emergency power source required by Subsection (a) may be powered by
3131 any type of fuel, including natural gas.
3232 (c) A nursing facility must comply with Subsection (a) not
3333 later than September 1, 2026. A facility may submit a request to
3434 the commission for an extension not to exceed one year to comply in
3535 good faith with Subsection (a). A facility may not request more
3636 than two additional one-year extensions and must separately request
3737 each extension. This subsection expires September 1, 2029.
3838 Sec. 242.054. GENERATOR INSPECTION. (a) In addition to the
3939 inspections required under Sections 242.043 and 242.044, the
4040 commission shall conduct an annual inspection of each facility's
4141 emergency generator or other power source required by Section
4242 242.053.
4343 (b) The executive commissioner by rule shall prescribe a
4444 checklist for an inspection conducted under this section.
4545 SECTION 2. Subchapter D, Chapter 247, Health and Safety
4646 Code, is amended by adding Sections 247.073 and 247.074 to read as
4747 follows:
4848 Sec. 247.073. EMERGENCY GENERATOR OR OTHER POWER SOURCE.
4949 (a) Each assisted living facility licensed under this chapter
5050 shall ensure the facility is equipped with an operational emergency
5151 generator or comparable emergency power source and a sufficient
5252 amount of fuel to operate the generator or power source during a
5353 power outage for a minimum of 72 hours in:
5454 (1) an area in the facility of sufficient size to at
5555 all times safely maintain residents as appropriate for resident
5656 needs; and
5757 (2) for a facility that maintains an installed unit
5858 locking device, as defined by commission rule, to restrict a
5959 resident's ability to exit a unit of the facility or the facility, a
6060 separately powered area in addition to an area described by
6161 Subdivision (1).
6262 (b) An operational emergency generator or comparable
6363 emergency power source required by Subsection (a) may be powered by
6464 any type of fuel, including natural gas.
6565 (c) An assisted living facility must comply with Subsection
6666 (a) not later than September 1, 2026. A facility may submit a
6767 request to the commission for an extension not to exceed one year to
6868 comply in good faith with Subsection (a). A facility may not
6969 request more than two additional one-year extensions and must
7070 separately request each extension. This subsection expires
7171 September 1, 2029.
7272 Sec. 247.074. GENERATOR INSPECTION. (a) In addition to the
7373 inspections required under Sections 247.023(a) and 247.027, the
7474 commission shall conduct an annual inspection of each facility's
7575 emergency generator or other power source required by Section
7676 247.073.
7777 (b) The executive commissioner by rule shall prescribe a
7878 checklist for an inspection conducted under this section.
7979 SECTION 3. As soon as practicable after the effective date
8080 of this Act, the executive commissioner of the Health and Human
8181 Services Commission shall adopt rules necessary to implement
8282 Sections 242.053, 242.054, 247.073, and 247.074, Health and Safety
8383 Code, as added by this Act.
8484 SECTION 4. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2025.
