77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the consideration of ownership interests of certain
1010 persons in determining whether a business is a historically
1111 underutilized business for purposes of state contracting.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2161.001(3), Government Code, is amended
1414 to read as follows:
1515 (3) "Economically disadvantaged person" means a
1616 person who:
1717 (A) is economically disadvantaged because of the
1818 person's identification as a member of a certain group, including:
1919 (i) Black Americans;
2020 (ii) Hispanic Americans;
2121 (iii) women;
2222 (iv) Asian Pacific Americans;
2323 (v) Native Americans; [and]
2424 (vi) veterans as defined by 38 U.S.C.
2525 Section 101(2) who have suffered at least a 20 percent
2626 service-connected disability as defined by 38 U.S.C. Section
2727 101(16);
2828 (vii) persons with a disability as defined
2929 by 42 U.S.C. Section 12102; and
3030 (viii) persons who identify as one or more
3131 of the following sexual orientations or gender identities:
3232 (a) gay;
3333 (b) lesbian;
3434 (c) bisexual;
3535 (d) transgender;
3636 (e) queer;
3737 (f) intersex; or
3838 (g) asexual; and
3939 (B) has suffered the effects of discriminatory
4040 practices or other similar insidious circumstances over which the
4141 person has no control.
4242 SECTION 2. Section 2161.002, Government Code, is amended by
4343 adding Subsection (e) to read as follows:
4444 (e) The comptroller shall adopt rules to provide goals for
4545 increasing the contract awards for the purchase of goods or
4646 services by the comptroller and other state agencies to businesses
4747 that qualify as a historically underutilized business because the
4848 business is at least 51 percent owned or is owned, operated, and
4949 controlled, as required by Section 2161.001(2), by one or more
5050 persons with a disability as defined by 42 U.S.C. Section 12102 or
5151 one or more persons who identify as one or more of the sexual
5252 orientations or gender identities described by Section
5353 2161.001(3)(A)(viii). The goals established under this subsection
5454 are in addition to the goals established under Subsections (c) and
5555 (d), and the goals established under Subsections (c) and (d) may not
5656 be reduced as a result of the establishment of goals under this
5757 subsection.
5858 SECTION 3. Section 2161.061, Government Code, is amended by
5959 adding Subsection (f) to read as follows:
6060 (f) To be certified by the comptroller as a historically
6161 underutilized business, a business owned by one or more persons who
6262 qualify as economically disadvantaged solely based on being a
6363 person with a disability as defined by 42 U.S.C. Section 12102 must
6464 submit to the comptroller an affidavit from a physician licensed to
6565 practice medicine in this state for each owner claiming a
6666 disability verifying that owner's disability.
6767 SECTION 4. Section 2161.125, Government Code, is amended to
6868 read as follows:
6969 Sec. 2161.125. CATEGORIZATION OF HISTORICALLY
7070 UNDERUTILIZED BUSINESSES. The comptroller, in cooperation with
7171 each state agency reporting under this subchapter, shall categorize
7272 each historically underutilized business included in a report under
7373 this subchapter by sex, race, and ethnicity and by whether the
7474 business qualifies as a historically underutilized business
7575 because it is owned or owned, operated, and controlled, as
7676 applicable, wholly or partly by one or more persons with a
7777 disability as defined by 42 U.S.C. Section 12102, one or more
7878 persons who identify as one or more of the sexual orientations or
7979 gender identities described by Section 2161.001(3)(A)(viii), or
8080 one or more veterans as defined by 38 U.S.C. Section 101(2) who have
8181 suffered at least a 20 percent service-connected disability as
8282 defined by 38 U.S.C. Section 101(16).
8383 SECTION 5. This Act takes effect September 1, 2025.
