| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 39.053, Education Code, is amended by | |
| 12 | 12 | adding Subsection (c-4) to read as follows: | |
| 13 | 13 | (c-4) For purposes of Subsection (c)(2)(B), the | |
| 14 | 14 | commissioner may not compare the relative performance of a campus | |
| 15 | 15 | in a district in which student enrollment is based only on a | |
| 16 | 16 | student's residence and the relative performance of a campus in a | |
| 17 | 17 | district in which a student's parent or person standing in parental | |
| 18 | 18 | relation to the student is allowed to enroll the student at a campus | |
| 19 | 19 | other than the campus the student would attend based on the | |
| 20 | 20 | student's residence. | |
| 21 | 21 | SECTION 2. This Act applies beginning with the 2023-2024 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2025. |
