77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dissolution by petition of a municipal management
1010 district; making conforming changes related to ship channel
1111 security districts.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 375.262, Local Government Code, is
1414 amended to read as follows:
1515 Sec. 375.262. DISSOLUTION BY PETITION BY OWNERS. (a)
1616 Except as limited by Section 375.264, the board shall dissolve the
1717 district on written petition filed with the board by the owners of
1818 the majority [at least two-thirds] of the assessed value of the
1919 property subject to assessment or taxation by the district based on
2020 the most recent certified county property tax rolls.
2121 (b) In all areas of conflict the provisions of this section
2222 take precedence over a special law governing a district.
2323 SECTION 2. Section 68.352(b), Water Code, is amended to
2424 read as follows:
2525 (b) A district may be dissolved as provided by Section
2626 375.262, Local Government Code, except that the written petition
2727 must be filed by the owners of at least two-thirds of the assessed
2828 value of the property subject to assessment or taxation by the
2929 district based on the most recent certified county property tax
3030 rolls.
3131 SECTION 3. The changes in law made by this Act apply only to
3232 a petition described by Section 375.262, Local Government Code,
3333 filed on or after the effective date of this Act. A petition filed
3434 before the effective date of this Act is governed by the law in
3535 effect on the date the petition was filed, and the former law is
3636 continued in effect for that purpose.
3737 SECTION 4. This Act takes effect September 1, 2025.
