77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to public access to personal financial statements filed by
1010 public officials and candidates.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 572.032, Government Code, is amended by
1313 amending Subsection (a) and adding Subsection (d) to read as
1414 follows:
1515 (a) Financial statements filed under this subchapter are
1616 public records. The commission shall:
1717 (1) maintain the statements in separate alphabetical
1818 files and in a manner that is accessible to the public during
1919 regular office hours; and
2020 (2) make each statement available to the public on the
2121 commission's Internet website not later than the 15th day after the
2222 date the statement is required to be filed or the date the statement
2323 is actually filed, whichever date is later.
2424 (d) The commission is not required to continue to make
2525 available on the commission's Internet website a financial
2626 statement that the commission may destroy under Subsection (c).
2727 The commission may not make available on the commission's Internet
2828 website a financial statement that the commission is required to
2929 destroy under Subsection (c).
3030 SECTION 2. Section 572.032(a-1), Government Code, as
3131 amended by Chapters 34 (S.B. 1576) and 983 (H.B. 776), Acts of the
3232 85th Legislature, Regular Session, 2017, is reenacted and amended
3333 to read as follows:
3434 (a-1) The commission shall remove the home address, the
3535 telephone number, and the names of the dependent children of an
3636 individual from a financial statement filed by the individual under
3737 this subchapter before:
3838 (1) permitting a member of the public to view the
3939 statement;
4040 (2) providing a copy of the statement to a member of
4141 the public; or
4242 (3) making the statement available to the public on
4343 the commission's Internet website[, if the commission makes
4444 statements filed under this subchapter available on its website].
4545 SECTION 3. Section 572.032(b), Government Code, is
4646 repealed.
4747 SECTION 4. This Act takes effect September 1, 2025.
