66 A BILL TO BE ENTITLED
77 AN ACT
88 related to expanding the exemptions of abortions and Texas women's
99 access to reproductive healthcare including in vitro
1010 fertilization.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. 170A.001 of the Health and Safety code is amended
1313 by adding Subsection (4)(5)(6) to section (b) to read as follows:
1414 (4) applied to instances where in vitro fertilization
1515 or fertility treatments of any type are used;
1616 (5) The use, prescription, administration, procuring,
1717 or selling of Plan B, morning-after pills, intrauterine devices, or
1818 any other type of contraception or emergency contraception;
1919 (6) An act performed with the purpose to:
2020 (A) Save the life or preserve the health of the
2121 unborn child;
2222 (B) Remove a dead unborn child caused by
2323 spontaneous abortion; or
2424 (C) Remove or treat an ectopic pregnancy, the
2525 implantation of a fertilized egg or embryo outside of the uterus.
2626 SECTION 2. Section 170.002, Health and Safety Code, is
2727 amended by adding Subsection (b-1) to read as follows:
2828 (b-1) Subsection (a) does not prohibit a physician from
2929 performing an abortion if:
3030 (1) the pregnant woman is 35 years of age or older or
3131 has a high-risk condition, as determined by the physician; or
3232 (2) the pregnancy resulted from in vitro
3333 fertilization.
3434 SECTION 3: This Act takes effect immediately if it receives a
3535 vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
