88 AN ACT
99 relating to healthy relationships education in public schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1212 amended by adding Section 28.0041 to read as follows:
1313 Sec. 28.0041. HEALTHY RELATIONSHIPS EDUCATION. (a) In
1414 this section, "age-appropriate" means suitable to particular ages
1515 or age groups of children or adolescents, based on developing
1616 cognitive, emotional, and behavioral capacity typical for the age
1717 or age group.
1818 (b) A school district shall provide healthy relationships
1919 education in accordance with this section at grade levels and in
2020 courses specified by the State Board of Education.
2121 (c) The State Board of Education by rule shall adopt the
2222 essential knowledge and skills for curricula to be used by a school
2323 district in providing healthy relationships education under this
2424 section that are age-appropriate and supported by research that is
2525 peer-reviewed, conducted in compliance with accepted scientific
2626 methods, and recognized as accurate by leading professional
2727 organizations and agencies with relevant experience. As
2828 age-appropriate, the curricula must promote relationship,
2929 communication, and decision-making skills, including strategies
3030 to:
3131 (1) develop healthy, age-appropriate relationships;
3232 (2) develop healthy life skills, including critical
3333 thinking, problem solving, effective communication, and
3434 responsible decision making about relationships; and
3535 (3) promote effective communication between
3636 adolescents and their parents, legal guardians, or other family
3737 members about relationships.
3838 (d) A school district shall make all curriculum materials
3939 used in the district's healthy relationships education available
4040 for reasonable public inspection.
4141 (e) A student shall be excused from healthy relationships
4242 education on the written request of a parent or legal guardian
4343 without being subjected to any disciplinary action, academic
4444 penalty, or other sanction imposed by the school district or the
4545 student's school.
4646 (f) A parent or legal guardian may use the grievance
4747 procedure adopted under Section 26.011 concerning a complaint of a
4848 violation of this section.
4949 (g) Before each school year, a school district shall provide
5050 written notice to a parent or legal guardian of each student
5151 enrolled in the district of the intent to provide healthy
5252 relationships education under this section. The notice must
5353 include:
5454 (1) a summary of the basic content of the healthy
5555 relationships education to be provided to the student;
5656 (2) a description of the curricula requirements for
5757 healthy relationships education under Subsection (c);
5858 (3) a statement of the parent's or legal guardian's
5959 right to:
6060 (A) review curriculum materials as provided by
6161 Subsection (d);
6262 (B) remove the student from any part of the
6363 district's healthy relationships education as provided by
6464 Subsection (e); and
6565 (C) use the grievance procedure adopted under
6666 Section 26.011 concerning a complaint of a violation of this
6767 section, as provided by Subsection (f); and
6868 (4) information regarding any opportunities for the
6969 parent or legal guardian to participate in the development of
7070 curricula for healthy relationships education.
7171 SECTION 2. Section 12.104(b), Education Code, is amended to
7272 read as follows:
7373 (b) An open-enrollment charter school is subject to:
7474 (1) a provision of this title establishing a criminal
7575 offense;
7676 (2) the provisions in Chapter 554, Government Code;
7777 and
7878 (3) a prohibition, restriction, or requirement, as
7979 applicable, imposed by this title or a rule adopted under this
8080 title, relating to:
8181 (A) the Public Education Information Management
8282 System (PEIMS) to the extent necessary to monitor compliance with
8383 this subchapter as determined by the commissioner;
8484 (B) criminal history records under Subchapter C,
8585 Chapter 22;
8686 (C) reading instruments and accelerated reading
8787 instruction programs under Section 28.006;
8888 (D) accelerated instruction under Section
8989 28.0211;
9090 (E) high school graduation requirements under
9191 Section 28.025;
9292 (F) special education programs under Subchapter
9393 A, Chapter 29;
9494 (G) bilingual education under Subchapter B,
9595 Chapter 29;
9696 (H) prekindergarten programs under Subchapter E
9797 or E-1, Chapter 29, except class size limits for prekindergarten
9898 classes imposed under Section 25.112, which do not apply;
9999 (I) extracurricular activities under Section
100100 33.081;
101101 (J) discipline management practices or behavior
102102 management techniques under Section 37.0021;
103103 (K) health and safety under Chapter 38;
104104 (L) the provisions of Subchapter A, Chapter 39;
105105 (M) public school accountability and special
106106 investigations under Subchapters A, B, C, D, F, G, and J, Chapter
107107 39, and Chapter 39A;
108108 (N) the requirement under Section 21.006 to
109109 report an educator's misconduct;
110110 (O) intensive programs of instruction under
111111 Section 28.0213;
112112 (P) the right of a school employee to report a
113113 crime, as provided by Section 37.148;
114114 (Q) bullying prevention policies and procedures
115115 under Section 37.0832;
116116 (R) the right of a school under Section 37.0052
117117 to place a student who has engaged in certain bullying behavior in a
118118 disciplinary alternative education program or to expel the student;
119119 (S) the right under Section 37.0151 to report to
120120 local law enforcement certain conduct constituting assault or
121121 harassment;
122122 (T) a parent's right to information regarding the
123123 provision of assistance for learning difficulties to the parent's
124124 child as provided by Sections 26.004(b)(11) and 26.0081(c) and (d);
125125 (U) establishment of residency under Section
126126 25.001;
127127 (V) school safety requirements under Sections
128128 37.0814, 37.108, 37.1081, 37.1082, 37.1083, 37.1084, 37.1085,
129129 37.1086, 37.109, 37.113, 37.114, 37.1141, 37.115, 37.207, and
130130 37.2071 and Subchapter J, Chapter 37;
131131 (W) the early childhood literacy and mathematics
132132 proficiency plans under Section 11.185;
133133 (X) the college, career, and military readiness
134134 plans under Section 11.186; [and]
135135 (Y) parental options to retain a student under
136136 Section 28.02124; and
137137 (Z) healthy relationships education under
138138 Section 28.0041.
139139 SECTION 3. This Act applies beginning with the 2026-2027
140140 school year.
141141 SECTION 4. This Act takes effect immediately if it receives
142142 a vote of two-thirds of all the members elected to each house, as
143143 provided by Section 39, Article III, Texas Constitution. If this
144144 Act does not receive the vote necessary for immediate effect, this
145145 Act takes effect September 1, 2025.
