| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 435.006(d), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (d) The department may not issue a producer dairy farm |
|---|
| 15 | 15 | | permit to a person for a bovine producer dairy farm located in an |
|---|
| 16 | 16 | | area infected with or at a high risk for bovine tuberculosis, as |
|---|
| 17 | 17 | | determined epidemiologically and defined by rule of the Texas |
|---|
| 18 | 18 | | Animal Health Commission. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2025. |
