| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 382.018, Health and Safety Code, is | |
| 14 | 14 | amended by adding Subsection (h) to read as follows: | |
| 15 | 15 | (h) The commission may not require notification to or | |
| 16 | 16 | authorization from a commission regional office as a prerequisite | |
| 17 | 17 | for conducting a controlled outdoor burn of combustible plant | |
| 18 | 18 | growth in a county in which a state of disaster or state of | |
| 19 | 19 | emergency has been declared by the governor or the president of the | |
| 20 | 20 | United States, unless the declaration expressly prohibits all | |
| 21 | 21 | outdoor burning. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2025. |
