77 AN ACT
88 relating to the qualifications for appointment as adjutant general.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 437.052(c), Government Code, is amended
1111 to read as follows:
1212 (c) To be eligible for appointment as adjutant general, a
1313 service member must:
1414 (1) at the time of appointment, be serving as an [a
1515 federally recognized] officer of not less than colonel in the Texas
1616 military forces [National Guard]; and
1717 (2) [have previously served on active duty or active
1818 duty for training with the United States Army or Air Force;
1919 [(3) meet for the year the appointment is made the
2020 submission requirements of the General Officer Federal Recognition
2121 Board or its successor; and
2222 [(4)] have completed at least 15 years of service as a
2323 [federally recognized reserve or active duty] commissioned officer
2424 with an active unit of the United States Army or Air Force[, the
2525 National Guard,] or the Texas military forces [National Guard,
2626 including at least five years with the Texas National Guard].
2727 SECTION 2. This Act takes effect September 1, 2025.
