66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to a standard and set of indicators in the academic
99 accountability system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.053(a), Education Code, is amended to
1212 read as follows:
1313 (a) The commissioner shall adopt a set of indicators of the
1414 quality of learning and achievement, including the indicators under
1515 Subsection (c). The commissioner periodically shall review the
1616 indicators for the consideration of appropriate revisions and
1717 ensure a cut score necessary for a district to receive an "A".
1818 (a-1) The indicators adopted by the commissioner under
1919 Subsection (a) must measure and evaluate school districts and
2020 campuses with respect to:
2121 (1) improving student preparedness for success in:
2222 (A) subsequent grade levels; and
2323 (B) entering the workforce, the military, or
2424 postsecondary education;
2525 (2) reducing, with the goal of eliminating, student
2626 academic achievement differentials among students from different
2727 racial and ethnic groups and socioeconomic backgrounds; and
2828 (3) informing parents and the community regarding
2929 campus and district performance.
3030 (b) Performance on the achievement indicators adopted under
3131 Subsection (c) shall be compared to state-established standards.
3232 The indicators must be based on information that is disaggregated
3333 by race, ethnicity, and socioeconomic status.
3434 (c) School districts and campuses must be evaluated based on
3535 three domains of indicators of achievement adopted under this
3636 section that include:
3737 (1) in the student achievement domain, indicators of
3838 student achievement that must include:
3939 (A) for evaluating the performance of districts
4040 and campuses generally:
4141 (i) an indicator that accounts for the
4242 results of assessment instruments required under Sections
4343 39.023(a), (c), and (l), as applicable for the district and campus,
4444 including the results of assessment instruments required for
4545 graduation retaken by a student, aggregated across grade levels by
4646 subject area, including:
4747 (a) for the performance standard
4848 determined by the commissioner under Section 39.0241(a), the
4949 percentage of students who performed satisfactorily on the
5050 assessment instruments, aggregated across grade levels by subject
5151 area; and
5252 (b) for the college readiness
5353 performance standard as determined under Section 39.0241, the
5454 percentage of students who performed satisfactorily on the
5555 assessment instruments, aggregated across grade levels by subject
5656 area; and
5757 (ii) an indicator that accounts for the
5858 results of assessment instruments required under Section
5959 39.023(b), as applicable for the district and campus, including the
6060 percentage of students who performed satisfactorily on the
6161 assessment instruments, as determined by the performance standard
6262 adopted by the agency, aggregated across grade levels by subject
6363 area; and
6464 (B) for evaluating the performance of high school
6565 campuses and districts that include high school campuses,
6666 indicators that account for:
6767 (i) students who satisfy the Texas Success
6868 Initiative (TSI) college readiness benchmarks prescribed by the
6969 Texas Higher Education Coordinating Board under Section 51.334 on
7070 an assessment instrument in reading or mathematics designated by
7171 the coordinating board under that section;
7272 (ii) students who satisfy relevant
7373 performance standards on advanced placement tests or similar
7474 assessments;
7575 (iii) students who earn dual course credits
7676 in the dual credit courses;
7777 (iv) students who enlist in the armed
7878 forces of the United States or the Texas National Guard;
7979 (v) students who earn industry
8080 certifications;
8181 (vi) students admitted into postsecondary
8282 industry certification programs that require as a prerequisite for
8383 entrance successful performance at the secondary level;
8484 (vii) students whose successful completion
8585 of a course or courses under Section 28.014 indicates the student's
8686 preparation to enroll and succeed, without remediation, in an
8787 entry-level general education course for a baccalaureate degree or
8888 associate degree;
8989 (viii) students who successfully met
9090 standards on a composite of indicators that through research
9191 indicates the student's preparation to enroll and succeed, without
9292 remediation, in an entry-level general education course for a
9393 baccalaureate degree or associate degree;
9494 (ix) high school graduation rates, computed
9595 in accordance with standards and definitions adopted in compliance
9696 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
9797 subject to the exclusions provided by Subsections (g), (g-1),
9898 (g-2), (g-3), and (g-4);
9999 (x) students who successfully completed an
100100 OnRamps dual enrollment course;
101101 (xi) students who successfully completed a
102102 practicum or internship approved by the State Board of Education;
103103 (xii) students who are awarded an associate
104104 degree; and
105105 (xiii) students who successfully completed
106106 a program of study in career and technical education;
107107 (2) in the school progress domain, indicators for
108108 effectiveness in promoting student learning, which must include:
109109 (A) for assessment instruments, including
110110 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
111111 percentage of students who met the standard for improvement, as
112112 determined by the commissioner; and
113113 (B) for evaluating relative performance, the
114114 performance of districts and campuses compared to similar districts
115115 or campuses; and
116116 (3) in the closing the gaps domain, the use of
117117 disaggregated data to demonstrate the differentials among students
118118 from different racial and ethnic groups, socioeconomic
119119 backgrounds, and other factors, including:
120120 (A) students formerly receiving special
121121 education services;
122122 (B) students continuously enrolled; and
123123 (C) students who are mobile.
124124 (c-1) An indicator adopted under Subsection (c) that would
125125 measure improvements in student achievement cannot negatively
126126 affect the commissioner's review of a school district or campus if
127127 that district or campus is already achieving at the highest level
128128 for that indicator.
129129 (c-2) The commissioner by rule shall determine a method by
130130 which a student's performance may be included in determining the
131131 performance rating of a school district or campus under Section
132132 39.054 if, before the student graduates, the student:
133133 (1) satisfies the Texas Success Initiative (TSI)
134134 college readiness benchmarks prescribed by the Texas Higher
135135 Education Coordinating Board under Section 51.334 on an assessment
136136 instrument designated by the coordinating board under that section;
137137 or
138138 (2) performs satisfactorily on an assessment
139139 instrument under Section 39.023(c), notwithstanding Subsection (d)
140140 of this section.
141141 (c-3) Any standard for improvement determined by the
142142 commissioner as described by Subsection (c)(2)(A) must allow for
143143 appropriately crediting a student for growth if the student
144144 performs at the highest achievement standard in the previous and
145145 current school year.
146146 (d) For purposes of Subsection (c), the commissioner by rule
147147 shall determine the period within which a student must retake an
148148 assessment instrument for that assessment instrument to be
149149 considered in determining the performance rating of the district
150150 under Section 39.054.
151151 (d-1) In aggregating results of assessment instruments
152152 across grade levels by subject in accordance with Subsection
153153 (c)(1)(A)(i), the performance of a student enrolled below the high
154154 school level on an assessment instrument required under Section
155155 39.023(c) is included with results relating to other students
156156 enrolled at the same grade level.
157157 (e) For purposes of Subsection (c)(3)(A), a student
158158 formerly receiving special education services means a student whose
159159 enrollment information:
160160 (1) for the preceding school year, as reported through
161161 the Public Education Information Management System (PEIMS),
162162 indicates the student was enrolled at the campus and was
163163 participating in a special education program; and
164164 (2) for the current school year, as reported through
165165 the Public Education Information Management System (PEIMS) and as
166166 reported on assessment instruments administered to the student
167167 under Section 39.023, indicates the student is enrolled at the
168168 campus and is not participating in a special education program.
169169 (f) Annually, the commissioner shall define the state
170170 standard for the current school year for each achievement indicator
171171 adopted under this section. In consultation with educators,
172172 parents, and business and industry representatives, as necessary,
173173 the commissioner shall establish and modify standards to
174174 continuously improve student performance to achieve the goals of
175175 eliminating achievement gaps based on race, ethnicity, and
176176 socioeconomic status and to ensure this state is a national leader
177177 in preparing students for postsecondary success.
178178 SECTION 2. This Act applies beginning with the 2023-2024
179179 school year.
180180 SECTION 3. This Act takes effect immediately if it receives
181181 a vote of two-thirds of all the members elected to each house, as
182182 provided by Section 39, Article III, Texas Constitution. If this
183183 Act does not receive the vote necessary for immediate effect, this
184184 Act takes effect September 1, 2025.
