| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 25.0344, Education Code, as added by |
|---|
| 12 | 12 | | Acts 2023, 88th Leg., R.S., Ch. 583 (H.B. 2892), Sec. 1, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF |
|---|
| 15 | 15 | | CERTAIN JUDGES, PEACE OFFICERS, PROSECUTING ATTORNEYS, AND |
|---|
| 16 | 16 | | SERVICEMEMBERS. (a) In this section: [,] |

| 17 | 17 | | (1) "peace officer" has the meaning assigned by |
|---|
| 18 | 18 | | Section 1701.001, Occupations Code. |
|---|
| 19 | 19 | | (2) "prosecuting attorney" includes a county |
|---|
| 20 | 20 | | prosecutor, state prosecutor, or state prosecuting attorney as |
|---|
| 21 | 21 | | defined in Section 46.001, Government Code. |
|---|
| 22 | 22 | | (3) "servicemember" means an active duty member of the |
|---|
| 23 | 23 | | armed forces of the United States, a reserve component of the armed |
|---|
| 24 | 24 | | forces of the United States, or the Texas National Guard. |
|---|
| 25 | 25 | | (4) "judge" means the judge of the supreme court, |
|---|
| 26 | 26 | | court of criminal appeals, appellate court, district court, or |
|---|
| 27 | 27 | | statutory county court, as well as any associate judge of the same. |
|---|
| 28 | 28 | | (b) On request of a judge, peace officer, prosecuting |
|---|
| 29 | 29 | | attorney, or servicemember who is a parent of or person standing in |
|---|
| 30 | 30 | | parental relation to a student, the board of trustees of a school |
|---|
| 31 | 31 | | district or the board's designee shall transfer the student to |
|---|
| 32 | 32 | | another district campus or to another school district under an |
|---|
| 33 | 33 | | agreement under Section 25.035. |
|---|
| 34 | 34 | | (c) A transfer under this section must be to the campus or |
|---|
| 35 | 35 | | school district, as applicable, selected by the judge, peace |
|---|
| 36 | 36 | | officer, prosecuting attorney, or servicemember making the |
|---|
| 37 | 37 | | request. |
|---|
| 38 | 38 | | (d) A school district is not required to provide |
|---|
| 39 | 39 | | transportation to a student who transfers to another campus or |
|---|
| 40 | 40 | | school district under this section. |
|---|
| 41 | 41 | | SECTION 2. Section 25.0344, Education Code, as added by |
|---|
| 42 | 42 | | Acts 2023, 88th Leg., R.S., Ch. 583 (H.B. 2892), Sec. 1, is |
|---|
| 43 | 43 | | repealed. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
