88 relating to the frequency of pay for state employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 659.081, 659.082, and 659.083,
1111 Government Code, are amended to read as follows:
1212 Sec. 659.081. PAYMENT ONCE A MONTH. Except as provided by
1313 this subchapter or the General Appropriations Act, annual salaries
1414 for state officers [and employees] shall be paid once a month.
1515 Sec. 659.082. PAYMENT TWICE A MONTH. (a) A state [An]
1616 employee shall [is entitled to] be paid employment compensation
1717 twice a month [if:
1818 (1) the employee is employed by:
1919 (A) the Texas Department of Mental Health and
2020 Mental Retardation;
2121 (B) the Texas Department of Transportation;
2222 (C) the Texas Department of Human Services;
2323 (D) the Texas Workforce Commission;
2424 (E) the Department of Public Safety; or
2525 (F) any other state agency designated by the
2626 comptroller;
2727 (2) the employee holds a classified position under the
2828 state's position classification plan;
2929 (3) the employee's position is classified below salary
3030 group Al2 under classification salary Schedule A in the General
3131 Appropriations Act;
3232 (4) the employing state agency satisfies the
3333 comptroller's requirements relating to the payment of compensation
3434 twice a month; and
3535 (5) at least 30 percent of the eligible employees of
3636 the agency choose to be paid twice a month.
3737 (b) Employees of an institution of higher education as
3838 defined by Section 61.003, Education Code, may be paid twice a month
3939 at the election of the employing institution of higher education].
4040 Sec. 659.083. PAYDAY. (a) Except as provided by Subsection
4141 (b), the comptroller may not pay the salary of a state officer or
4242 employee before the first working day of the month following the
4343 payroll period.
4444 (b) The comptroller shall pay a state [an] employee [who is
4545 paid twice a month under Section 659.082] on:
4646 (1) the first working day of the month following the
4747 payroll period that covers the last half of the preceding month; and
4848 (2) the 15th day of the month or the first working day
4949 after the 15th for the payroll period that covers the first half of
5050 the month.
5151 (c) In this section, "working day" means a day other than
5252 Saturday, Sunday, or a national holiday as listed in the General
5353 Appropriations Act or Chapter 662. A day does not cease to be a
5454 national holiday because a state agency maintains or is required to
5555 maintain a minimum working staff on the holiday.
5656 SECTION 2. Sections 659.081, 659.082, and 659.083,
5757 Government Code, as amended by this Act, apply only to compensation
5858 due for services rendered on or after September 1, 2025. Employment
5959 compensation due for services rendered prior September 1, 2025, is
6060 governed by the law in effect on the date the services were
6161 rendered, and the former law is continued in effect for that
6262 purpose.
6363 SECTION 3. This Act takes effect September 1, 2025.
