88 AN ACT
99 relating to establishment of maximum allowable ground level
1010 concentrations of hydrogen sulfide by the Texas Commission on
1111 Environmental Quality.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 382, Health and Safety
1414 Code, is amended by adding Section 382.0217 to read as follows:
1515 Sec. 382.0217. MAXIMUM ALLOWABLE GROUND LEVEL
1616 CONCENTRATIONS OF HYDROGEN SULFIDE. (a) To protect public health,
1717 the commission shall:
1818 (1) by rule establish maximum allowable ground level
1919 concentrations of hydrogen sulfide; and
2020 (2) subject to Subsection (b), review the latest
2121 health studies regarding hydrogen sulfide emissions and reevaluate
2222 the maximum allowable concentrations at least once every five
2323 years.
2424 (b) In establishing the maximum allowable concentrations,
2525 the commission:
2626 (1) may establish different concentrations based on
2727 whether an area is used for residential, recreational, business,
2828 commercial, or agricultural purposes; and
2929 (2) may not allow any person to cause or allow
3030 emissions of hydrogen sulfide from a source or sources operated on a
3131 property or multiple sources operated on contiguous properties to
3232 exceed a net ground level concentration of:
3333 (A) 0.04 parts per million averaged over any
3434 30-minute period if the downwind concentration of hydrogen sulfide
3535 affects a property used for residential, recreational, business, or
3636 commercial purposes; or
3737 (B) 0.06 parts per million averaged over any
3838 30-minute period if the downwind concentration of hydrogen sulfide
3939 affects only property used for purposes other than residential,
4040 recreational, business, or commercial purposes.
4141 (c) The commission by rule shall classify a violation of the
4242 allowable ground level concentrations established by this section
4343 as having major significance under Section 5.754, Water Code.
4444 SECTION 2. Not later than September 1, 2026, the Texas
4545 Commission on Environmental Quality shall adopt rules required by
4646 Section 382.0217, Health and Safety Code, as added by this Act.
4747 SECTION 3. This Act takes effect September 1, 2025.
