77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prosecution of the offense of exploitation of a
1010 child, elderly individual, or disabled individual.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.53(a), Penal Code, is amended by
1313 adding Subdivisions (1-a), (1-b), and (3) and amending Subdivision
1414 (2) to read as follows:
1515 (1-a) "Coercion" as defined by Section 1.07 includes:
1616 (A) destroying, concealing, confiscating, or
1717 withholding from a person, or threatening to destroy, conceal,
1818 confiscate, or withhold from a person, the person's actual or
1919 purported:
2020 (i) government records; or
2121 (ii) identifying information or documents;
2222 (B) providing a controlled substance to a person
2323 for the purpose of impairing the person's ability to appraise the
2424 nature of or resist engaging in any conduct;
2525 (C) physically restraining or confining a person
2626 or threatening to physically restrain or confine a person;
2727 (D) exposing or threatening to expose
2828 information that would tend to subject a person to criminal or
2929 immigration proceedings; or
3030 (E) causing or threatening to cause financial
3131 harm to a person or using financial control over a person.
3232 (1-b) "Deception" means:
3333 (A) creating or confirming by words or conduct a
3434 false impression of law or fact that is likely to affect the
3535 judgment of another in the transaction, and that the actor does not
3636 believe to be true; or
3737 (B) promising performance that is likely to
3838 affect the judgment of another in the transaction and that the actor
3939 does not intend to perform or knows will not be performed.
4040 (2) "Exploitation" means the illegal or improper use
4141 of a child, elderly individual, or disabled individual or of the
4242 resources of a child, elderly individual, or disabled individual
4343 through undue influence, harassment, duress, false representation,
4444 false pretense, or other similar means [for monetary or personal
4545 benefit, profit, or gain].
4646 (3) "Isolation" means preventing a person from having
4747 contact with the person's friends or family, a welfare agency,
4848 peace officers, health care providers, or other individuals or
4949 entities without the knowledge or consent of the person.
5050 SECTION 2. Section 32.53(b), Penal Code, is amended to read
5151 as follows:
5252 (b) A person commits an offense if the person, through
5353 exploitation, deception, coercion, or isolation, knowingly
5454 appropriates the resources of a child, elderly individual, or
5555 disabled individual for the person's own monetary or personal
5656 benefit or for the monetary or personal benefit of another person
5757 other than the child, elderly individual, or disabled individual
5858 [intentionally, knowingly, or recklessly causes the exploitation
5959 of a child, elderly individual, or disabled individual].
6060 SECTION 3. The change in law made by this Act applies only
6161 to an offense committed on or after the effective date of this Act.
6262 An offense committed before the effective date of this Act is
6363 governed by the law in effect on the date the offense was committed,
6464 and the former law is continued in effect for that purpose. For
6565 purposes of this section, an offense was committed before the
6666 effective date of this Act if any element of the offense occurred
6767 before that date.
6868 SECTION 4. This Act takes effect September 1, 2025.
