| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter F, Chapter 2B, Code of Criminal |
|---|
| 14 | 14 | | Procedure, is amended by adding Article 2B.0254 to read as follows: |

| 15 | 15 | | Art. 2B.0254. LAW ENFORCEMENT POLICY ON DISCHARGE OF |
|---|
| 16 | 16 | | FIREARM AT MOVING VEHICLE. (a) In this article, "law enforcement |
|---|
| 17 | 17 | | agency" means an agency of the state or an agency of a political |
|---|
| 18 | 18 | | subdivision of the state authorized by law to employ peace |
|---|
| 19 | 19 | | officers. |
|---|
| 20 | 20 | | (b) Each law enforcement agency shall adopt a policy |
|---|
| 21 | 21 | | regarding a peace officer discharging a firearm at or in the |
|---|
| 22 | 22 | | direction of a moving vehicle. |
|---|
| 23 | 23 | | (c) A policy adopted under this article must prohibit a |
|---|
| 24 | 24 | | peace officer from discharging a firearm at or in the direction of a |
|---|
| 25 | 25 | | moving vehicle unless the peace officer discharges the firearm only |
|---|
| 26 | 26 | | when and to the degree the officer reasonably believes is |
|---|
| 27 | 27 | | immediately necessary to protect the officer or another person from |
|---|
| 28 | 28 | | the use of unlawful deadly force by an occupant of the vehicle by |
|---|
| 29 | 29 | | means other than by using the moving vehicle to strike any person. |
|---|
| 30 | 30 | | SECTION 2. Each law enforcement agency in this state shall |
|---|
| 31 | 31 | | adopt the policy required by Article 2B.0254, Code of Criminal |
|---|
| 32 | 32 | | Procedure, as added by this Act, as soon as practicable after the |
|---|
| 33 | 33 | | effective date of this Act. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
