77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of uninsured or underinsured motorist
1010 coverage in automobile liability insurance policies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 912.002(b), Insurance Code, is amended
1313 to read as follows:
1414 (b) A county mutual insurance company is subject to:
1515 (1) Sections 38.001, 401.051, 401.052,
1616 401.054-401.062, 401.151, 401.152, 401.155, 401.156, 501.159,
1717 501.202, 501.203, 822.204, 1806.001, 1806.101, 1806.103(b),
1818 1806.104-1806.107, 1953.051(b), 2002.002, and 2002.005;
1919 (2) Subchapter A, Chapter 86;
2020 (3) Subchapter A, Chapter 401;
2121 (4) the provisions of Subchapter B, Chapter 424, other
2222 than Sections 424.052, 424.072, and 424.073;
2323 (5) Chapters 221, 251, 252, 254, 541, and 2210; [and]
2424 (6) Subchapter C, Chapter 1952; and
2525 (7) Articles 5.39 and 5.40.
2626 SECTION 2. Section 2301.053(b), Insurance Code, is amended
2727 to read as follows:
2828 (b) Each form for a personal automobile insurance policy
2929 must provide the coverages mandated under:
3030 (1) Subchapter [Subchapters] C, Chapter 1952; and
3131 (2) Subchapter D, Chapter 1952, unless the coverage is
3232 [coverages are] rejected by the named insured in the manner
3333 provided by that subchapter [those subchapters].
3434 SECTION 3. Section 1952.101(c), Insurance Code, is
3535 repealed.
3636 SECTION 4. The change in law made by this Act applies only
3737 to an insurance policy that is delivered, issued for delivery, or
3838 renewed on or after January 1, 2026. A policy delivered, issued for
3939 delivery, or renewed before January 1, 2026, is governed by the law
4040 as it existed immediately before the effective date of this Act, and
4141 that law is continued in effect for that purpose.
4242 SECTION 5. This Act takes effect September 1, 2025.
