77 AN ACT
88 relating to a prohibition on weather modification and control;
99 creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 9, Agriculture Code, is amended by adding
1212 Chapter 303 to read as follows:
1313 CHAPTER 303. WEATHER MODIFICATION AND CONTROL PROHIBITED
1414 Sec. 303.001. DEFINITION. In this chapter, "weather
1515 modification and control" means the injection, release, or
1616 dispersion, by any means, of a chemical, chemical compound,
1717 substance, or apparatus for the purpose of affecting temperature,
1818 weather, or the intensity of sunlight.
1919 Sec. 303.002. PROHIBITION ON WEATHER MODIFICATION AND
2020 CONTROL. A person may not engage in weather modification and
2121 control.
2222 Sec. 303.003. ENFORCEMENT. (a) A person commits an offense
2323 if the person violates this chapter.
2424 (b) An offense under this section is a Class A misdemeanor.
2525 (c) A person commits a separate offense for each day the
2626 violation occurs.
2727 SECTION 2. Chapters 301 and 302, Agriculture Code, are
2828 repealed.
2929 SECTION 3. The changes in law made by this Act apply only to
3030 an offense committed on or after the effective date of this Act. An
3131 offense committed before the effective date of this Act is governed
3232 by the law in effect on the date the offense was committed, and the
3333 former law is continued in effect for that purpose. For purposes of
3434 this section, an offense was committed before the effective date of
3535 this Act if any element of the offense occurred before that date.
3636 SECTION 4. (a) An action, including a disciplinary or
3737 administrative proceeding, pending under Chapter 301, Agriculture
3838 Code, or Chapter 51, Occupations Code, on the effective date of this
3939 Act related to a violation of Chapter 301, Agriculture Code, as that
4040 chapter existed immediately before the effective date of this Act,
4141 is dismissed.
4242 (b) An administrative penalty assessed by the Texas
4343 Commission of Licensing and Regulation before the effective date of
4444 this Act related to a violation of Chapter 301, Agriculture Code, as
4545 that chapter existed immediately before the effective date of this
4646 Act, may be collected as provided by Chapter 51, Occupations Code.
4747 (c) The Texas Department of Licensing and Regulation shall
4848 return to a person who holds a valid license or permit issued under
4949 Chapter 301, Agriculture Code, as that chapter existed immediately
5050 before the effective date of this Act, a prorated portion of the fee
5151 paid to the department for the issuance or renewal of the license or
5252 permit.
5353 SECTION 5. This Act takes effect September 1, 2025.
