77 AN ACT
88 relating to the labeling of beef and beef products; providing a
99 civil penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 431, Health and Safety
1212 Code, is amended by adding Section 431.085 to read as follows:
1313 Sec. 431.085. REQUIRED LABELING OF BEEF AND BEEF PRODUCTS;
1414 CIVIL PENALTY. (a) A retailer of beef or a beef product shall affix
1515 a label to the container of the meat or product designating the
1616 country of origin of the meat or of the meat used to make the
1717 product. If any unwrapped or unpackaged beef or beef product is
1818 displayed for sale, the retailer shall clearly label with the
1919 country of origin the display case or container in which the meat or
2020 product is displayed.
2121 (b) A retailer who violates Subsection (a) is liable to this
2222 state for a civil penalty of $1,000 for each day the violation
2323 continues.
2424 (c) The attorney general may sue to collect a civil penalty
2525 under this section and may recover reasonable expenses incurred in
2626 obtaining the penalty, including investigative costs, court costs,
2727 reasonable attorney's fees, witness fees, and deposition expenses.
2828 SECTION 2. This Act takes effect September 1, 2025.
