77 AN ACT
88 Relating to the requirement of a school district to notify a parent
99 of curriculum or instructional material containing religion or
1010 religious values.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 26.010, Education Code, is amended by
1313 adding Subsections (c), (c-1), and (c-2) to read as follows:
1414 (c) Before each school year, and a week prior to any
1515 specific instruction, a school district shall provide through
1616 personal delivery, mail, or electronic mail, written notice to a
1717 parent of each student enrolled in the district of any curriculum,
1818 instructional material, or school activity providing instruction
1919 on religion or religious values, including references to:
2020 (1) religious literature or texts;
2121 (2) religious policies;
2222 (3) religious sects or orders;
2323 (4) religious figures;
2424 (5) religious beliefs;
2525 (6) religious holy days;
2626 (7) a particular religion's impacts on history; or
2727 (8) religious institutions, partnerships,
2828 associations, corporations, or a department, division, or section
2929 of one of those entities.
3030 (c-1) A notice under this section must include:
3131 (1) a statement informing the parent of the
3232 requirements of instruction containing religion or religious
3333 values under state law;
3434 (2) a detailed description of the content of the
3535 district's instruction containing religion or religious values and
3636 a general schedule on which the instruction will be provided;
3737 (3) a statement of the parent's right to:
3838 (A) at the parent's discretion, review or
3939 purchase a copy of curriculum materials as provided by Section
4040 26.006 and Section 26.0061;
4141 (B) remove the student from any part of the
4242 district's instruction containing religion or religious values
4343 without subjecting the student to disciplinary action, academic
4444 penalty, or other sanction imposed by the district or the student's
4545 school; and
4646 (C) use the grievances procedure as provided by
4747 Section 26.011 concerning a complaint of a violation of this
4848 section.
4949 (c-2) A parent may use the grievance procedure adopted under
5050 Section 26.011 concerning a complaint or a violation of this
5151 section.
5252 SECTION 2. This Act takes effect September 1, 2025.
