| 8 | 8 | | Relating to the requirement of a school district to notify a parent |

| 9 | 9 | | of curriculum or instructional material containing religion or |
|---|
| 10 | 10 | | religious values. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 26.010, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsections (c), (c-1), and (c-2) to read as follows: |
|---|
| 14 | 14 | | (c) Before each school year, and a week prior to any |
|---|
| 15 | 15 | | specific instruction, a school district shall provide through |
|---|
| 16 | 16 | | personal delivery, mail, or electronic mail, written notice to a |
|---|
| 17 | 17 | | parent of each student enrolled in the district of any curriculum, |
|---|
| 18 | 18 | | instructional material, or school activity providing instruction |
|---|
| 19 | 19 | | on religion or religious values, including references to: |
|---|
| 20 | 20 | | (1) religious literature or texts; |
|---|
| 21 | 21 | | (2) religious policies; |
|---|
| 22 | 22 | | (3) religious sects or orders; |
|---|
| 23 | 23 | | (4) religious figures; |
|---|
| 24 | 24 | | (5) religious beliefs; |
|---|
| 25 | 25 | | (6) religious holy days; |
|---|
| 26 | 26 | | (7) a particular religion's impacts on history; or |
|---|
| 27 | 27 | | (8) religious institutions, partnerships, |
|---|
| 28 | 28 | | associations, corporations, or a department, division, or section |
|---|
| 29 | 29 | | of one of those entities. |
|---|
| 30 | 30 | | (c-1) A notice under this section must include: |
|---|
| 31 | 31 | | (1) a statement informing the parent of the |
|---|
| 32 | 32 | | requirements of instruction containing religion or religious |
|---|
| 33 | 33 | | values under state law; |
|---|
| 34 | 34 | | (2) a detailed description of the content of the |
|---|
| 35 | 35 | | district's instruction containing religion or religious values and |
|---|
| 36 | 36 | | a general schedule on which the instruction will be provided; |
|---|
| 37 | 37 | | (3) a statement of the parent's right to: |
|---|
| 38 | 38 | | (A) at the parent's discretion, review or |
|---|
| 39 | 39 | | purchase a copy of curriculum materials as provided by Section |
|---|
| 40 | 40 | | 26.006 and Section 26.0061; |
|---|
| 41 | 41 | | (B) remove the student from any part of the |
|---|
| 42 | 42 | | district's instruction containing religion or religious values |
|---|
| 43 | 43 | | without subjecting the student to disciplinary action, academic |
|---|
| 44 | 44 | | penalty, or other sanction imposed by the district or the student's |
|---|
| 45 | 45 | | school; and |
|---|
| 46 | 46 | | (C) use the grievances procedure as provided by |
|---|
| 47 | 47 | | Section 26.011 concerning a complaint of a violation of this |
|---|
| 48 | 48 | | section. |
|---|
| 49 | 49 | | (c-2) A parent may use the grievance procedure adopted under |
|---|
| 50 | 50 | | Section 26.011 concerning a complaint or a violation of this |
|---|
| 51 | 51 | | section. |
|---|
| 52 | 52 | | SECTION 2. This Act takes effect September 1, 2025. |
