77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to sovereign immunity and civil rights actions related to
1010 certain laws protecting the free exercise of religion.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 84.0067(a)(1), Civil Practice and
1313 Remedies Code, is amended to read as follows:
1414 (1) "Religious organization" means an [a charitable]
1515 organization that:
1616 (A) if the organization's primary purpose and
1717 function are religious, is:
1818 (i) a religious school organized primarily
1919 for religious and educational purposes; or
2020 (ii) a religious charity organized
2121 primarily for religious and charitable purposes; or
2222 (B) does not engage in activities that would
2323 disqualify it from tax-exempt status under Section 501(c)(3),
2424 Internal Revenue Code of 1986, as it existed on August 30, 1999 [is
2525 a religious organization under Section 110.011(b)].
2626 SECTION 2. Section 110.008, Civil Practice and Remedies
2727 Code, is amended to read as follows:
2828 Sec. 110.008. SOVEREIGN IMMUNITY WAIVED. (a) Subject to
2929 Section 110.006 and except as provided by Subsection (b), sovereign
3030 immunity to suit and from liability is waived and abolished in state
3131 and federal court to the extent of liability created by Section
3232 110.005, and a claimant may sue a government agency for damages
3333 allowed by that section.
3434 (b) Notwithstanding Subsection (a), this chapter does not
3535 waive or abolish sovereign immunity to suit and from liability
3636 under the Eleventh Amendment to the United States Constitution,
3737 which prohibits the citizens of another state or the citizens or
3838 subjects of a foreign state from suing this state or any arm of this
3939 state in federal court.
4040 SECTION 3. Section 2400.001(5), Government Code, is amended
4141 to read as follows:
4242 (5) "Religious organization" means an organization
4343 that:
4444 (A) if the organization's primary purpose and
4545 function are religious, is:
4646 (i) a religious school organized primarily
4747 for religious and educational purposes; or
4848 (ii) a religious charity organized
4949 primarily for religious and charitable purposes; or
5050 (B) does not engage in activities that would
5151 disqualify it from tax-exempt status under Section 501(c)(3),
5252 Internal Revenue Code of 1986, as it existed on August 30, 1999 [is
5353 a religious organization under Section 110.011(b), Civil Practice
5454 and Remedies Code].
5555 SECTION 4. Section 2401.001(4), Government Code, is amended
5656 to read as follows:
5757 (4) "Religious organization" means an organization
5858 open to the public that:
5959 (A) if the organization's primary purpose and
6060 function are religious, is:
6161 (i) a religious school organized primarily
6262 for religious and educational purposes; or
6363 (ii) a religious charity organized
6464 primarily for religious and charitable purposes; or
6565 (B) does not engage in activities that would
6666 disqualify it from tax-exempt status under Section 501(c)(3),
6767 Internal Revenue Code of 1986, as it existed on August 30, 1999 [is
6868 a religious organization under Section 110.011(b), Civil Practice
6969 and Remedies Code].
7070 SECTION 5. Section 110.011, Civil Practice and Remedies
7171 Code, is repealed.
7272 SECTION 6. This Act takes effect September 1, 2025.
