77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to signs posted under the memorial sign program for
1010 victims of certain vehicle collisions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 201.909(e), (f), and (g),
1313 Transportation Code, are amended to read as follows:
1414 (e) If the application meets the department's requirements
1515 and the applicant pays the memorial sign fee, the department shall
1616 erect a sign. A sign posted under this section may remain posted for
1717 ten [two] years. At the end of the ten-year [two-year] period the
1818 department may release the sign to the applicant. The department is
1919 not required to release a sign that has been damaged.
2020 (f) A sign posted under this section that is damaged shall
2121 be removed by the department. Except as provided in Subsection (g),
2222 the department may post a new sign if it has been less than ten [two]
2323 years from the posting of the original sign and a person:
2424 (1) submits a written request to the department to
2525 replace the sign; and
2626 (2) submits a replacement fee in the amount provided
2727 under Subsection (d)(2).
2828 (g) During the ten-year [two-year] posting period the
2929 department shall replace a sign posted under this section that is
3030 damaged because of the department's negligence.
3131 SECTION 2. This Act takes effect September 1, 2025.
