77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on the use of public money to pay for the
1010 alteration of a roadway related to high-speed rail construction.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 199.003, Transportation
1313 Code, is amended to read as follows:
1414 Sec. 199.003. USE OF PUBLIC [STATE] MONEY FOR HIGH-SPEED
1515 RAIL.
1616 SECTION 2. Sections 199.003(a) and (b), Transportation
1717 Code, are amended to read as follows:
1818 (a) For the purposes of this section: [,]
1919 (1) "High-speed [high-speed] rail" means intercity
2020 passenger rail service that is reasonably expected to reach speeds
2121 of at least 110 miles per hour.
2222 (2) "Public money" means money of this state, a state
2323 agency, or a political subdivision of this state or money the state,
2424 state agency, or political subdivision controls or directs.
2525 (b) Except as required by federal law or other state law,
2626 including the National Environmental Policy Act of 1969 (42 U.S.C.
2727 Section 4321 et seq.):
2828 (1) the legislature may not appropriate money to pay
2929 for a cost of planning, facility construction or maintenance, or
3030 security for, promotion of, or operation of, high-speed rail
3131 operated by a private entity; [and]
3232 (2) a state agency may not accept or use public [state]
3333 money to pay for a cost described by Subdivision (1); and
3434 (3) this state, a state agency, or a political
3535 subdivision of this state may not use public money to pay for the
3636 alteration of a roadway related to the construction of a high-speed
3737 rail project operated by a public or private entity.
3838 SECTION 3. This Act takes effect September 1, 2025.
