| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. The heading to Section 199.003, Transportation |
|---|
| 13 | 13 | | Code, is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 199.003. USE OF PUBLIC [STATE] MONEY FOR HIGH-SPEED |
|---|
| 15 | 15 | | RAIL. |
|---|
| 16 | 16 | | SECTION 2. Sections 199.003(a) and (b), Transportation |
|---|
| 17 | 17 | | Code, are amended to read as follows: |
|---|
| 18 | 18 | | (a) For the purposes of this section: [,] |
|---|
| 19 | 19 | | (1) "High-speed [high-speed] rail" means intercity |
|---|
| 20 | 20 | | passenger rail service that is reasonably expected to reach speeds |
|---|
| 21 | 21 | | of at least 110 miles per hour. |
|---|
| 22 | 22 | | (2) "Public money" means money of this state, a state |
|---|
| 23 | 23 | | agency, or a political subdivision of this state or money the state, |
|---|
| 24 | 24 | | state agency, or political subdivision controls or directs. |
|---|
| 25 | 25 | | (b) Except as required by federal law or other state law, |
|---|
| 26 | 26 | | including the National Environmental Policy Act of 1969 (42 U.S.C. |
|---|
| 27 | 27 | | Section 4321 et seq.): |
|---|
| 28 | 28 | | (1) the legislature may not appropriate money to pay |
|---|
| 29 | 29 | | for a cost of planning, facility construction or maintenance, or |
|---|
| 30 | 30 | | security for, promotion of, or operation of, high-speed rail |
|---|
| 31 | 31 | | operated by a private entity; [and] |
|---|
| 32 | 32 | | (2) a state agency may not accept or use public [state] |
|---|
| 33 | 33 | | money to pay for a cost described by Subdivision (1); and |
|---|
| 34 | 34 | | (3) this state, a state agency, or a political |
|---|
| 35 | 35 | | subdivision of this state may not use public money to pay for the |
|---|
| 36 | 36 | | alteration of a roadway related to the construction of a high-speed |
|---|
| 37 | 37 | | rail project operated by a public or private entity. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2025. |
