11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter D, Chapter 501, Government Code, is | |
13 | 13 | amended by adding Section 501.115 to read as follows: | |
14 | 14 | Sec. 501.115. LIMITATION ON USE OF ADMINISTRATIVE | |
15 | 15 | SEGREGATION. (a) In this section, "serious bodily injury" has the | |
16 | 16 | meaning assigned by Section 1.07, Penal Code. | |
17 | 17 | (b) Except as provided by Subsection (c), the department may | |
18 | 18 | not confine an inmate in administrative segregation for more than | |
19 | 19 | three consecutive days based on misconduct by the inmate. | |
20 | 20 | (c) The department may confine an inmate in administrative | |
21 | 21 | segregation for not more than 10 consecutive days for engaging in | |
22 | 22 | conduct that resulted in serious bodily injury to another person. | |
23 | 23 | SECTION 2. The change in law made by this Act applies to any | |
24 | 24 | inmate who is confined in a facility operated by or under contract | |
25 | 25 | with the Texas Department of Criminal Justice on or after the | |
26 | 26 | effective date of this Act, regardless of whether the offense for | |
27 | 27 | which the inmate is confined occurred before, on, or after the | |
28 | 28 | effective date of this Act. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2025. |
