77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to limitations on the use of administrative segregation by
1010 the Texas Department of Criminal Justice.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 501, Government Code, is
1313 amended by adding Section 501.115 to read as follows:
1414 Sec. 501.115. LIMITATION ON USE OF ADMINISTRATIVE
1515 SEGREGATION. (a) In this section, "serious bodily injury" has the
1616 meaning assigned by Section 1.07, Penal Code.
1717 (b) Except as provided by Subsection (c), the department may
1818 not confine an inmate in administrative segregation for more than
1919 three consecutive days based on misconduct by the inmate.
2020 (c) The department may confine an inmate in administrative
2121 segregation for not more than 10 consecutive days for engaging in
2222 conduct that resulted in serious bodily injury to another person.
2323 SECTION 2. The change in law made by this Act applies to any
2424 inmate who is confined in a facility operated by or under contract
2525 with the Texas Department of Criminal Justice on or after the
2626 effective date of this Act, regardless of whether the offense for
2727 which the inmate is confined occurred before, on, or after the
2828 effective date of this Act.
2929 SECTION 3. This Act takes effect September 1, 2025.
