77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the punishment for the offense of driving while license
1010 invalid.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 14.06(d), Code of Criminal Procedure, is
1313 amended to read as follows:
1414 (d) Subsection (c) applies only to a person charged with
1515 committing an offense under:
1616 (1) Section 481.121, Health and Safety Code, if the
1717 offense is punishable under Subsection (b)(1) or (2) of that
1818 section;
1919 (1-a) Section 481.1161, Health and Safety Code, if the
2020 offense is punishable under Subsection (b)(1) or (2) of that
2121 section;
2222 (2) Section 28.03, Penal Code, if the offense is
2323 punishable under Subsection (b)(2) of that section;
2424 (3) Section 28.08, Penal Code, if the offense is
2525 punishable under Subsection (b)(2) or (3) of that section;
2626 (4) Section 31.03, Penal Code, if the offense is
2727 punishable under Subsection (e)(2)(A) of that section;
2828 (5) Section 31.04, Penal Code, if the offense is
2929 punishable under Subsection (e)(2) of that section;
3030 (5-a) Section 37.10, Penal Code, if the offense is for
3131 tampering with a temporary tag issued under Chapter 502 or 503,
3232 Transportation Code; or
3333 (6) Section 38.114, Penal Code, if the offense is
3434 punishable as a Class B misdemeanor [; or
3535 [(7) Section 521.457, Transportation Code].
3636 SECTION 2. Section 521.457(e), Transportation Code, is
3737 amended to read as follows:
3838 (e) Except as provided by Subsections [(f),] (f-1)[,] and
3939 (f-2), an offense under this section is a Class C misdemeanor.
4040 SECTION 3. Section 521.457(f), Transportation Code, is
4141 repealed.
4242 SECTION 4. The change in law made by this Act applies only
4343 to an offense committed on or after the effective date of this Act.
4444 An offense committed before the effective date of this Act is
4545 governed by the law in effect on the date the offense was committed,
4646 and the former law is continued in effect for that purpose. For
4747 purposes of this section, an offense was committed before the
4848 effective date of this Act if any element of the offense occurred
4949 before that date.
5050 SECTION 5. This Act takes effect September 1, 2025.
