77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on the issuance or enforcement of a search
1010 warrant, subpoena, or other court order for certain menstrual
1111 health data.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 18, Code of Criminal Procedure, is
1414 amended by adding Article 18.0216 to read as follows:
1515 Art. 18.0216. MENSTRUAL HEALTH DATA: SEARCH AND SEIZURE
1616 PROHIBITED. (a) In this article, "menstrual health data" means any
1717 information, recorded in any format, that is created or received by
1818 an entity and that relates to or is used to determine, predict, or
1919 estimate an individual's past, present, or future menstrual health
2020 or menstrual cycles.
2121 (b) Notwithstanding Article 18.02 or any other provision of
2222 this code, a magistrate may not issue a search warrant, subpoena, or
2323 other court order, and a law enforcement agency may not serve,
2424 execute, or otherwise enforce a search warrant, subpoena, or other
2525 court order for purposes of searching for, seizing, or ordering the
2626 production of the menstrual health data of an individual, including
2727 data stored on a computer, computer network, or other device
2828 containing electronic or digital information.
2929 (c) Menstrual health data obtained in violation of this
3030 article and expert testimony related to the data are inadmissible
3131 in a criminal action.
3232 SECTION 2. This Act takes effect September 1, 2025.
