77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to restrictive covenants regulating certain landscaping
1010 and water conservation practices.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 202.007(a) and (d), Property Code, are
1313 amended to read as follows:
1414 (a) A property owners' association may not include or
1515 enforce a provision in a dedicatory instrument that prohibits or
1616 restricts a property owner from:
1717 (1) implementing measures promoting solid-waste
1818 composting of vegetation, including grass clippings, leaves, or
1919 brush, or leaving grass clippings uncollected on grass;
2020 (2) installing rain barrels or a rainwater harvesting
2121 system;
2222 (3) implementing efficient irrigation systems,
2323 including underground drip or other drip systems; [or]
2424 (4) using drought-resistant landscaping in lieu of
2525 natural turf; or
2626 (5) using water-conserving natural turf.
2727 (d) This section does not:
2828 (1) restrict a property owners' association from
2929 regulating the requirements, including size, type, shielding, and
3030 materials, for or the location of a composting device if the
3131 restriction does not prohibit the economic installation of the
3232 device on the property owner's property where there is reasonably
3333 sufficient area to install the device;
3434 (2) require a property owners' association to permit a
3535 device described by Subdivision (1) to be installed in or on
3636 property:
3737 (A) owned by the property owners' association;
3838 (B) owned in common by the members of the
3939 property owners' association; or
4040 (C) in an area other than the fenced yard or patio
4141 of a property owner;
4242 (3) prohibit a property owners' association from
4343 regulating the installation of efficient irrigation systems,
4444 including establishing visibility limitations for aesthetic
4545 purposes;
4646 (4) prohibit a property owners' association from
4747 regulating the installation or use of gravel, rocks, or cacti;
4848 (5) restrict a property owners' association from
4949 regulating yard and landscape maintenance if the restrictions or
5050 requirements do not restrict or prohibit turf or landscaping design
5151 that promotes water conservation;
5252 (6) require a property owners' association to permit a
5353 rain barrel or rainwater harvesting system to be installed in or on
5454 property if:
5555 (A) the property is:
5656 (i) owned by the property owners'
5757 association;
5858 (ii) owned in common by the members of the
5959 property owners' association; or
6060 (iii) located between the front of the
6161 property owner's home and an adjoining or adjacent street; or
6262 (B) the barrel or system:
6363 (i) is of a color other than a color
6464 consistent with the color scheme of the property owner's home; or
6565 (ii) displays any language or other content
6666 that is not typically displayed by such a barrel or system as it is
6767 manufactured;
6868 (7) restrict a property owners' association from
6969 regulating the size, type, and shielding of, and the materials used
7070 in the construction of, a rain barrel, rainwater harvesting device,
7171 or other appurtenance that is located on the side of a house or at
7272 any other location that is visible from a street, another lot, or a
7373 common area if:
7474 (A) the restriction does not prohibit the
7575 economic installation of the device or appurtenance on the property
7676 owner's property; and
7777 (B) there is a reasonably sufficient area on the
7878 property owner's property in which to install the device or
7979 appurtenance; or
8080 (8) prohibit a property owners' association from
8181 requiring an owner to submit a detailed description or a plan for
8282 the installation of drought-resistant landscaping or
8383 water-conserving natural turf for review and approval by the
8484 property owners' association to ensure, to the extent practicable,
8585 maximum aesthetic compatibility with other landscaping in the
8686 subdivision, provided that a property owners' association:
8787 (A) shall accept an outline and diagram or
8888 representation for the installation submitted by the owner; and
8989 (B) may not require an owner to submit a detailed
9090 description or plan prepared by a landscape architect or other
9191 professional provider of landscaping services.
9292 SECTION 2. Section 202.007(e), Property Code, is repealed.
9393 SECTION 3. This Act takes effect September 1, 2025.
