77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Department of Family and Protective Services'
1010 annual report of key performance measures and data elements for
1111 child protection; authorizing a penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 264.001, Family Code, is amended by
1414 adding Subdivision (6) to read as follows:
1515 (6) "Substitute care" has the meaning assigned by
1616 Section 263.001.
1717 SECTION 2. Section 264.017, Family Code, is amended by
1818 amending Subsection (b) and adding Subsection (g) to read as
1919 follows:
2020 (b) The department shall provide the report required by
2121 Subsection (a) to the legislature and shall publish the report and
2222 make the report available electronically to the public, including
2323 by posting the report on the department's Internet website, not
2424 later than February 1 of each year. The report must include, with
2525 respect to the preceding year:
2626 (1) information on the number and disposition of
2727 reports of child abuse and neglect received by the department;
2828 (2) information on the number of children [clients]
2929 for whom the department took protective action, including
3030 investigations, alternative responses, and court-ordered removals;
3131 (3) information on the number of children [clients]
3232 for whom the department provided services in each program
3333 administered by the child protective services division, including
3434 investigations, alternative responses, family-based safety
3535 services, conservatorship, post-adoption services, and
3636 transitional living services;
3737 (4) the number of children in this state who died as a
3838 result of child abuse or neglect;
3939 (5) the number of children described by Subdivision
4040 (4) for whom the department was the children's managing conservator
4141 at the time of death;
4242 (6) information on the timeliness of the department's
4343 initial contact in an investigation or alternative response;
4444 (7) information on the response time by the department
4545 in commencing services to families and children for whom an
4646 allegation of child abuse or neglect has been made;
4747 (8) information regarding child protection staffing
4848 and caseloads by program area;
4949 (9) information on the permanency goals in place and
5050 achieved for children in the managing conservatorship of the
5151 department, including information on the timeliness of achieving
5252 the goals, the stability of the children's placement in foster
5353 care, and the proximity of placements to the children's home
5454 counties;
5555 (10) the number of children who suffer from a severe
5656 emotional disturbance and for whom the department is appointed
5757 managing conservator, including statistics on appointments as
5858 joint managing conservator, due to an individual voluntarily
5959 relinquishing custody of a child solely to obtain mental health
6060 services for the child;
6161 (11) the number of children who are pregnant or a
6262 parent while in the managing conservatorship of the department and
6363 the number of the children born to a parent in the managing
6464 conservatorship of the department who are placed in the managing
6565 conservatorship of the department;
6666 (12) the number of children who are missing from the
6767 children's substitute care provider while in the managing
6868 conservatorship of the department; [and]
6969 (13) of the children identified under Subdivision
7070 (12):
7171 (A) the number of children who were located and
7272 returned to substitute care;
7373 (B) the actions taken by the department to locate
7474 those children; and
7575 (C) the outcome of each child's case;
7676 (14) the number of children who were victims of
7777 trafficking under Chapter 20A, Penal Code, while in the managing
7878 conservatorship of the department;
7979 (15) of the children identified under Subdivision
8080 (14):
8181 (A) the actions taken by the department to
8282 resolve each case; and
8383 (B) the outcome of each child's case;
8484 (16) information on the program under Subchapter I,
8585 including:
8686 (A) the number of children placed with a relative
8787 or designated caregiver;
8888 (B) the percentage of children in the managing
8989 conservatorship of the department who are placed with a relative or
9090 designated caregiver;
9191 (C) statistics on the age and race of the
9292 children placed with a relative or designated caregiver;
9393 (D) the number of children placed with a relative
9494 or designated caregiver who were part of a sibling group;
9595 (E) the number of relative or designated
9696 caregivers who receive financial assistance; and
9797 (F) outcome information for children placed with
9898 a relative or designated caregiver including:
9999 (i) how many months children spent with a
100100 relative or designated caregiver before a case was closed;
101101 (ii) the rates of types of resolutions for
102102 closed cases; and
103103 (iii) statistics comparing the outcomes for
104104 relative or designated caregiver placements with and without
105105 financial assistance;
106106 (17) information on the number of substitute care
107107 providers, other than relative or designated caregivers, who
108108 received financial assistance;
109109 (18) the number of complaints brought against
110110 substitute care providers;
111111 (19) the number of children in relative or designated
112112 caregiver placements reunified with their families; and
113113 (20) the number of children in substitute care, other
114114 than relative or designated caregiver placements, reunified with
115115 their families.
116116 (g) The comptroller shall assess a penalty against the
117117 department in the amount of $1,000 for each day after February 1 the
118118 department has not filed the report under Subsection (b). The
119119 comptroller shall reallocate the amount assessed as a penalty under
120120 this subsection as necessary to allow the department to use the
121121 money to provide monetary assistance to relative and other
122122 designated caregivers under Section 264.755.
123123 SECTION 3. This Act takes effect September 1, 2025.
