| 10 | 10 | | using funds allotted under the instructional materials and |

| 11 | 11 | | technology allotment. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 31.0211(c), Education Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (c) Funds allotted under this section may be used to: |
|---|
| 16 | 16 | | (1) purchase: |
|---|
| 17 | 17 | | (A) instructional materials[, regardless of |
|---|
| 18 | 18 | | whether the instructional materials are] on the list of approved |
|---|
| 19 | 19 | | instructional materials maintained by the State Board of Education |
|---|
| 20 | 20 | | under Section 31.022; |
|---|
| 21 | 21 | | (B) consumable instructional materials, |
|---|
| 22 | 22 | | including workbooks; |
|---|
| 23 | 23 | | (C) instructional materials for use in bilingual |
|---|
| 24 | 24 | | education classes, as provided by Section 31.029; |
|---|
| 25 | 25 | | (D) instructional materials for use in college |
|---|
| 26 | 26 | | preparatory courses under Section 28.014, as provided by Section |
|---|
| 27 | 27 | | 31.031; |
|---|
| 28 | 28 | | (E) supplemental instructional materials; |
|---|
| 29 | 29 | | (F) open education resource instructional |
|---|
| 30 | 30 | | materials, as provided by Subchapter B-1; |
|---|
| 31 | 31 | | (G) instructional materials and technological |
|---|
| 32 | 32 | | equipment under any continuing contracts of the district in effect |
|---|
| 33 | 33 | | on September 1, 2011; |
|---|
| 34 | 34 | | (H) technological equipment necessary to support |
|---|
| 35 | 35 | | the use of any instructional materials purchased with an allotment |
|---|
| 36 | 36 | | under this section; |
|---|
| 37 | 37 | | (I) inventory software or systems for storing, |
|---|
| 38 | 38 | | managing, and accessing instructional materials and analyzing the |
|---|
| 39 | 39 | | usage and effectiveness of the instructional materials; and |
|---|
| 40 | 40 | | (J) services, equipment, and technology |
|---|
| 41 | 41 | | infrastructure necessary to ensure Internet connectivity and |
|---|
| 42 | 42 | | adequate bandwidth; and |
|---|
| 43 | 43 | | (2) pay: |
|---|
| 44 | 44 | | (A) for training educational personnel directly |
|---|
| 45 | 45 | | involved in student learning in the appropriate use of |
|---|
| 46 | 46 | | instructional materials and for providing for access to |
|---|
| 47 | 47 | | technological equipment for instructional use; |
|---|
| 48 | 48 | | (B) for training personnel in the electronic |
|---|
| 49 | 49 | | administration of assessment instruments; |
|---|
| 50 | 50 | | (C) the salary and other expenses of an employee |
|---|
| 51 | 51 | | who provides technical support for the use of technological |
|---|
| 52 | 52 | | equipment directly involved in student learning; and |
|---|
| 53 | 53 | | (D) for costs associated with distance learning, |
|---|
| 54 | 54 | | including Wi-Fi, Internet access hotspots, wireless network |
|---|
| 55 | 55 | | service, broadband service, and other services and technological |
|---|
| 56 | 56 | | equipment necessary to facilitate Internet access. |
|---|
| 57 | 57 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 58 | 58 | | school year. |
|---|
| 59 | 59 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 60 | 60 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 61 | 61 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 62 | 62 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 63 | 63 | | Act takes effect September 1, 2025. |
