77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a school district's purchase of instructional materials
1010 using funds allotted under the instructional materials and
1111 technology allotment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 31.0211(c), Education Code, is amended
1414 to read as follows:
1515 (c) Funds allotted under this section may be used to:
1616 (1) purchase:
1717 (A) instructional materials[, regardless of
1818 whether the instructional materials are] on the list of approved
1919 instructional materials maintained by the State Board of Education
2020 under Section 31.022;
2121 (B) consumable instructional materials,
2222 including workbooks;
2323 (C) instructional materials for use in bilingual
2424 education classes, as provided by Section 31.029;
2525 (D) instructional materials for use in college
2626 preparatory courses under Section 28.014, as provided by Section
2727 31.031;
2828 (E) supplemental instructional materials;
2929 (F) open education resource instructional
3030 materials, as provided by Subchapter B-1;
3131 (G) instructional materials and technological
3232 equipment under any continuing contracts of the district in effect
3333 on September 1, 2011;
3434 (H) technological equipment necessary to support
3535 the use of any instructional materials purchased with an allotment
3636 under this section;
3737 (I) inventory software or systems for storing,
3838 managing, and accessing instructional materials and analyzing the
3939 usage and effectiveness of the instructional materials; and
4040 (J) services, equipment, and technology
4141 infrastructure necessary to ensure Internet connectivity and
4242 adequate bandwidth; and
4343 (2) pay:
4444 (A) for training educational personnel directly
4545 involved in student learning in the appropriate use of
4646 instructional materials and for providing for access to
4747 technological equipment for instructional use;
4848 (B) for training personnel in the electronic
4949 administration of assessment instruments;
5050 (C) the salary and other expenses of an employee
5151 who provides technical support for the use of technological
5252 equipment directly involved in student learning; and
5353 (D) for costs associated with distance learning,
5454 including Wi-Fi, Internet access hotspots, wireless network
5555 service, broadband service, and other services and technological
5656 equipment necessary to facilitate Internet access.
5757 SECTION 2. This Act applies beginning with the 2025-2026
5858 school year.
5959 SECTION 3. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2025.
