77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dedication of certain federal money received for
1010 public education and the distribution to school districts of
1111 certain excess funds appropriated for the Foundation School
1212 Program.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 1, Education Code, is amended by adding
1515 Section 1.008 to read as follows:
1616 Sec. 1.008. DEDICATION OF FEDERAL MONEY. Money received
1717 from the federal government for the purposes of public primary and
1818 secondary education may be appropriated only for purposes related
1919 to public primary and secondary education in this state.
2020 SECTION 2. Subchapter F, Chapter 48, Education Code, is
2121 amended by adding Section 48.284 to read as follows:
2222 Sec. 48.284. DISTRIBUTION OF EXCESS FUNDS. Notwithstanding
2323 any other provision of law, not later than September 1 of any year
2424 following a school year in which the commissioner determines that
2525 the amount appropriated for purposes of the Foundation School
2626 Program exceeded the amount to which school districts were entitled
2727 under this chapter, the commissioner shall:
2828 (1) notify the Legislative Budget Board of the excess
2929 funds; and
3030 (2) distribute the excess funds, less the amount
3131 required to comply with Section 48.265, as determined by the
3232 commissioner, to each school district in an equal amount per
3333 student in weighted average daily attendance for the previous
3434 school year.
3535 SECTION 3. This Act takes effect September 1, 2025.
