| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Chapter 1, Education Code, is amended by adding |
|---|
| 15 | 15 | | Section 1.008 to read as follows: |
|---|
| 16 | 16 | | Sec. 1.008. DEDICATION OF FEDERAL MONEY. Money received |
|---|
| 17 | 17 | | from the federal government for the purposes of public primary and |
|---|
| 18 | 18 | | secondary education may be appropriated only for purposes related |
|---|
| 19 | 19 | | to public primary and secondary education in this state. |
|---|
| 20 | 20 | | SECTION 2. Subchapter F, Chapter 48, Education Code, is |
|---|
| 21 | 21 | | amended by adding Section 48.284 to read as follows: |
|---|
| 22 | 22 | | Sec. 48.284. DISTRIBUTION OF EXCESS FUNDS. Notwithstanding |
|---|
| 23 | 23 | | any other provision of law, not later than September 1 of any year |
|---|
| 24 | 24 | | following a school year in which the commissioner determines that |
|---|
| 25 | 25 | | the amount appropriated for purposes of the Foundation School |
|---|
| 26 | 26 | | Program exceeded the amount to which school districts were entitled |
|---|
| 27 | 27 | | under this chapter, the commissioner shall: |
|---|
| 28 | 28 | | (1) notify the Legislative Budget Board of the excess |
|---|
| 29 | 29 | | funds; and |
|---|
| 30 | 30 | | (2) distribute the excess funds, less the amount |
|---|
| 31 | 31 | | required to comply with Section 48.265, as determined by the |
|---|
| 32 | 32 | | commissioner, to each school district in an equal amount per |
|---|
| 33 | 33 | | student in weighted average daily attendance for the previous |
|---|
| 34 | 34 | | school year. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
