77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring public institutions of higher education to
1010 report certain information regarding gifts, grants, donations, and
1111 investments received from certain foreign sources.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.986 to read as follows:
1515 Sec. 51.986. REPORTS ON GIFTS, GRANTS, DONATIONS, AND
1616 INVESTMENTS RECEIVED FROM CERTAIN FOREIGN SOURCES. (a) In this
1717 section:
1818 (1) "Coordinating board" means the Texas Higher
1919 Education Coordinating Board.
2020 (2) "Foreign source" means:
2121 (A) a foreign government or agency of a foreign
2222 government;
2323 (B) a legal entity, including a for-profit or
2424 nonprofit organization, created solely under the laws of a foreign
2525 government or an affiliate or subsidiary acting on behalf of the
2626 legal entity;
2727 (C) an individual who is not a citizen or
2828 national of the United States, including a territory or
2929 protectorate of the United States; or
3030 (D) an agent acting on behalf of an individual or
3131 entity described by Paragraph (A), (B), or (C).
3232 (3) "Institution of higher education" has the meaning
3333 assigned by Section 61.003.
3434 (b) Four times each year on dates designated by the
3535 coordinating board, each institution of higher education shall
3636 prepare and submit to the coordinating board a report detailing
3737 each gift, grant, donation, or investment the institution received
3838 from a foreign source during the most recent calendar quarter.
3939 (c) Unless disclosure of the information is prohibited or
4040 the information is confidential under federal or state law, the
4141 report must include for each gift, grant, donation, or investment:
4242 (1) the amount of money or other thing of value
4343 received;
4444 (2) the date on which the money or other thing of value
4545 was received;
4646 (3) the identity of the foreign source and, if not a
4747 foreign government, the country of citizenship, if known, and the
4848 country of principal residence or domicile of the foreign source;
4949 (4) the purpose for which the money or other thing of
5050 value is being used; and
5151 (5) any conditions established by the foreign source
5252 regarding how the money or other thing of value may be used.
5353 (d) The coordinating board shall make available to the
5454 public on the coordinating board's Internet website each report
5555 made under this section.
5656 (e) The coordinating board may adopt rules as necessary to
5757 implement this section.
5858 SECTION 2. This Act takes effect January 1, 2026.
