| 10 | 10 | | report certain information regarding gifts, grants, donations, and |
|---|
| 11 | 11 | | investments received from certain foreign sources. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 51.986 to read as follows: |
|---|
| 15 | 15 | | Sec. 51.986. REPORTS ON GIFTS, GRANTS, DONATIONS, AND |
|---|
| 16 | 16 | | INVESTMENTS RECEIVED FROM CERTAIN FOREIGN SOURCES. (a) In this |
|---|
| 17 | 17 | | section: |
|---|
| 18 | 18 | | (1) "Coordinating board" means the Texas Higher |
|---|
| 19 | 19 | | Education Coordinating Board. |
|---|
| 20 | 20 | | (2) "Foreign source" means: |
|---|
| 21 | 21 | | (A) a foreign government or agency of a foreign |
|---|
| 22 | 22 | | government; |
|---|
| 23 | 23 | | (B) a legal entity, including a for-profit or |
|---|
| 24 | 24 | | nonprofit organization, created solely under the laws of a foreign |
|---|
| 25 | 25 | | government or an affiliate or subsidiary acting on behalf of the |
|---|
| 26 | 26 | | legal entity; |
|---|
| 27 | 27 | | (C) an individual who is not a citizen or |
|---|
| 28 | 28 | | national of the United States, including a territory or |
|---|
| 29 | 29 | | protectorate of the United States; or |
|---|
| 30 | 30 | | (D) an agent acting on behalf of an individual or |
|---|
| 31 | 31 | | entity described by Paragraph (A), (B), or (C). |
|---|
| 32 | 32 | | (3) "Institution of higher education" has the meaning |
|---|
| 33 | 33 | | assigned by Section 61.003. |
|---|
| 34 | 34 | | (b) Four times each year on dates designated by the |
|---|
| 35 | 35 | | coordinating board, each institution of higher education shall |
|---|
| 36 | 36 | | prepare and submit to the coordinating board a report detailing |
|---|
| 37 | 37 | | each gift, grant, donation, or investment the institution received |
|---|
| 38 | 38 | | from a foreign source during the most recent calendar quarter. |
|---|
| 39 | 39 | | (c) Unless disclosure of the information is prohibited or |
|---|
| 40 | 40 | | the information is confidential under federal or state law, the |
|---|
| 41 | 41 | | report must include for each gift, grant, donation, or investment: |
|---|
| 42 | 42 | | (1) the amount of money or other thing of value |
|---|
| 43 | 43 | | received; |
|---|
| 44 | 44 | | (2) the date on which the money or other thing of value |
|---|
| 45 | 45 | | was received; |
|---|
| 46 | 46 | | (3) the identity of the foreign source and, if not a |
|---|
| 47 | 47 | | foreign government, the country of citizenship, if known, and the |
|---|
| 48 | 48 | | country of principal residence or domicile of the foreign source; |
|---|
| 49 | 49 | | (4) the purpose for which the money or other thing of |
|---|
| 50 | 50 | | value is being used; and |
|---|
| 51 | 51 | | (5) any conditions established by the foreign source |
|---|
| 52 | 52 | | regarding how the money or other thing of value may be used. |
|---|
| 53 | 53 | | (d) The coordinating board shall make available to the |
|---|
| 54 | 54 | | public on the coordinating board's Internet website each report |
|---|
| 55 | 55 | | made under this section. |
|---|
| 56 | 56 | | (e) The coordinating board may adopt rules as necessary to |
|---|
| 57 | 57 | | implement this section. |
|---|
| 58 | 58 | | SECTION 2. This Act takes effect January 1, 2026. |
