88 relating to the protection of students from sexual grooming.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Add a new Subchapter H, Chapter 38, Education
1111 Code, to read as follows:
1212 SUBCHAPTER H. SEXUAL GROOMING PROTECTION ACT
1313 Sec. 38.401. SEXUAL GOOMING PROTECTION.(a)
1414 Notwithstanding any other provision of this code, as provided by
1515 this subchapter a parent who determines that their child is
1616 subjected to sexual grooming at a public school is entitled to the
1717 right to protect their child from such sexual grooming by selecting
1818 another school, public or private, for their child in which event
1919 Chapter 48 funding for the education of that child shall flow with
2020 the child to the new school selected by the parents.
2121 Sec. 38.402. DEFINITION. Sexual Grooming is defined as any
2222 effort to desensitize children to sexual experiences, or to
2323 normalize sexual relationships with adults or children of the same
2424 or opposite sex.
2525 Sec. 38.403. ACCREDITED PRIVATE SCHOOL PARTICIPATION (a)
2626 The commissioner shall adopt rules to implement the program,
2727 including rules providing for maintenance and operations funding to
2828 follow the child. Rules shall be designed to prohibit fraud and
2929 abuse. The rules may not in any form effect or attempt to control
3030 the programs, curricula, or other operations of private schools who
3131 participate in the program other than rules for accredited private
3232 schools which were in effect January 1, 2025. (b) No federal funds
3333 or Available School Funds shall be used to fund programs under this
3434 subsection.
3535 SECTION 2. This Act takes effect September 1, 2025
