| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 31.07, Penal Code, is amended by |
|---|
| 10 | 12 | | amending subsection (a) and (b) to read as follows: |
|---|
| 11 | 13 | | (a) A person commits an offense if he intentionally or |
|---|
| 12 | 14 | | knowingly operates another's boat, airplane, or motor-propelled |
|---|
| 13 | 15 | | vehicle: [without the effective consent of the owner.] |
|---|
| 14 | 16 | | (1) without the effective consent of the owner; or |
|---|
| 15 | 17 | | (2) without the effective consent of the owner and |
|---|
| 16 | 18 | | with knowledge that the ignition or steering system of the boat, |
|---|
| 17 | 19 | | airplane, or motor-propelled vehicle had been altered, damaged, or |
|---|
| 18 | 20 | | tampered with. |

| 19 | 21 | | (b) An offense under [this section is a state jail felony] |
|---|
| 20 | 22 | | section (a)(1) is a state jail felony. An offense under section |
|---|
| 21 | 23 | | (a)(2) is a felony of the third degree. |

| 22 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 25 | | to an offense committed on or after the effective date of this Act. |
|---|
| 24 | 26 | | An offense committed before the effective date of this Act is |
|---|
| 25 | 27 | | governed by the law in effect on the date the offense was committed, |
|---|
| 26 | 28 | | and the former law is continued in effect for that purpose. For |
|---|
| 27 | 29 | | purposes of this section, an offense was committed before the |
|---|
| 28 | 30 | | effective date of this Act if any element of the offense occurred |
|---|
| 29 | 31 | | before that date. |

| 30 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
