77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to liability for the provision of certain medical
1010 treatment to a pregnant woman by a physician or health care
1111 provider.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. This Act shall be known as the Life of the Mother
1414 Act.
1515 SECTION 2. Section 74.552(a), Civil Practice and Remedies
1616 Code, is amended to read as follows:
1717 (a) It is an affirmative defense to liability in a civil
1818 action brought against a physician or health care provider for a
1919 violation of Section 170A.002, Health and Safety Code, including an
2020 action to recover a civil penalty under Section 170A.005, Health
2121 and Safety Code, that the physician or health care provider
2222 exercised reasonable medical judgment in providing medical
2323 treatment to a pregnant woman in response to:
2424 (1) an ectopic pregnancy at any location; [or]
2525 (2) a previable premature rupture of membranes; or
2626 (3) any other pregnancy complication that has been
2727 diagnosed by a physician and that has a substantial likelihood of
2828 causing serious bodily injury, as defined by Section 1.07, Penal
2929 Code.
3030 SECTION 3. This Act takes effect September 1, 2025.
