12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. This Act shall be known as the Life of the Mother | |
14 | 14 | Act. | |
15 | 15 | SECTION 2. Section 74.552(a), Civil Practice and Remedies | |
16 | 16 | Code, is amended to read as follows: | |
17 | 17 | (a) It is an affirmative defense to liability in a civil | |
18 | 18 | action brought against a physician or health care provider for a | |
19 | 19 | violation of Section 170A.002, Health and Safety Code, including an | |
20 | 20 | action to recover a civil penalty under Section 170A.005, Health | |
21 | 21 | and Safety Code, that the physician or health care provider | |
22 | 22 | exercised reasonable medical judgment in providing medical | |
23 | 23 | treatment to a pregnant woman in response to: | |
24 | 24 | (1) an ectopic pregnancy at any location; [or] | |
25 | 25 | (2) a previable premature rupture of membranes; or | |
26 | 26 | (3) any other pregnancy complication that has been | |
27 | 27 | diagnosed by a physician and that has a substantial likelihood of | |
28 | 28 | causing serious bodily injury, as defined by Section 1.07, Penal | |
29 | 29 | Code. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2025. |
