77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the monitoring of emissions from certain concrete
1010 plants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.05195, Health and Safety Code, is
1313 amended by amending Subsection (k) and adding Subsection (l) to
1414 read as follows:
1515 (k) An application for an authorization to use [the issuance
1616 of] a standard permit under this section for a concrete plant that
1717 performs wet batching, dry batching, or central mixing, including a
1818 permanent, temporary, or specialty concrete batch plant, as defined
1919 by the commission, must include a plot plan that clearly shows:
2020 (1) a distance scale;
2121 (2) a north arrow;
2222 (3) all property lines, emission points, buildings,
2323 tanks, and process vessels and other process equipment in the area
2424 in which the facility will be located;
2525 (4) at least two benchmark locations in the area in
2626 which the facility will be located; and
2727 (5) if the permit requires a distance, setback, or
2828 buffer from other property or structures as a condition of the
2929 permit, whether the required distance or setback will be met.
3030 (l) The commission shall prescribe reasonable requirements
3131 for the regular monitoring of the emissions of air contaminants
3232 from facilities described by Subsection (k) that regularly operate
3333 at or near any applicable hourly production rate maximum set by the
3434 applicable standard permit.
3535 SECTION 2. This Act takes effect September 1, 2025.
