| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 382.05195, Health and Safety Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (k) and adding Subsection (l) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (k) An application for an authorization to use [the issuance |
|---|
| 16 | 16 | | of] a standard permit under this section for a concrete plant that |
|---|
| 17 | 17 | | performs wet batching, dry batching, or central mixing, including a |
|---|
| 18 | 18 | | permanent, temporary, or specialty concrete batch plant, as defined |
|---|
| 19 | 19 | | by the commission, must include a plot plan that clearly shows: |
|---|
| 20 | 20 | | (1) a distance scale; |
|---|
| 21 | 21 | | (2) a north arrow; |
|---|
| 22 | 22 | | (3) all property lines, emission points, buildings, |
|---|
| 23 | 23 | | tanks, and process vessels and other process equipment in the area |
|---|
| 24 | 24 | | in which the facility will be located; |
|---|
| 25 | 25 | | (4) at least two benchmark locations in the area in |
|---|
| 26 | 26 | | which the facility will be located; and |
|---|
| 27 | 27 | | (5) if the permit requires a distance, setback, or |
|---|
| 28 | 28 | | buffer from other property or structures as a condition of the |
|---|
| 29 | 29 | | permit, whether the required distance or setback will be met. |
|---|
| 30 | 30 | | (l) The commission shall prescribe reasonable requirements |
|---|
| 31 | 31 | | for the regular monitoring of the emissions of air contaminants |
|---|
| 32 | 32 | | from facilities described by Subsection (k) that regularly operate |
|---|
| 33 | 33 | | at or near any applicable hourly production rate maximum set by the |
|---|
| 34 | 34 | | applicable standard permit. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2025. |
