| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 5, Water Code, is amended |
|---|
| 13 | 13 | | by adding Section 5.1245 to read as follows: |
|---|
| 14 | 14 | | Sec. 5.1245. ENVIRONMENTAL PRODUCT DECLARATION GRANT |
|---|
| 15 | 15 | | PROGRAM FOR MANUFACTURERS OF READY-MIXED CONCRETE. (a) In this |
|---|
| 16 | 16 | | section, "environmental product declaration" means an |
|---|
| 17 | 17 | | independently verified product-specific label that discloses the |
|---|
| 18 | 18 | | environmental impact of a manufactured product based on a life |
|---|
| 19 | 19 | | cycle assessment. |
|---|
| 20 | 20 | | (b) The commission shall establish and administer a grant |
|---|
| 21 | 21 | | program to reimburse manufacturers of ready-mixed concrete for the |
|---|
| 22 | 22 | | cost of accessing an environmental product declaration database or |
|---|
| 23 | 23 | | other software for generating environmental product declarations |
|---|
| 24 | 24 | | for ready-mixed concrete products. |
|---|
| 25 | 25 | | (c) As a condition of receiving a grant under this section, |
|---|
| 26 | 26 | | a manufacturer must agree to use environmental product declarations |
|---|
| 27 | 27 | | for the manufacturer's ready-mixed concrete products. |
|---|
| 28 | 28 | | (d) The commission shall adopt rules to implement the |
|---|
| 29 | 29 | | program established under this section, including rules |
|---|
| 30 | 30 | | establishing: |
|---|
| 31 | 31 | | (1) eligibility criteria for grant applicants; |
|---|
| 32 | 32 | | (2) grant application procedures; |
|---|
| 33 | 33 | | (3) criteria for evaluating grant applications and |
|---|
| 34 | 34 | | awarding grants; |
|---|
| 35 | 35 | | (4) guidelines related to grant amounts; and |
|---|
| 36 | 36 | | (5) procedures for monitoring the use of a grant |
|---|
| 37 | 37 | | awarded under this section and ensuring compliance with any |
|---|
| 38 | 38 | | conditions of the grant. |
|---|
| 39 | 39 | | SECTION 2. The Texas Commission on Environmental Quality |
|---|
| 40 | 40 | | shall adopt rules and establish procedures under Section 5.1245, |
|---|
| 41 | 41 | | Water Code, as added by this Act, as soon as practicable after the |
|---|
| 42 | 42 | | effective date of this Act. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
