| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 382.0651 to read as follows: |
|---|
| 14 | 14 | | Sec. 382.0651. LOCATION AND OPERATION OF CERTAIN CONCRETE |
|---|
| 15 | 15 | | BATCH PLANTS. (a) In this section, "concrete batch plant" means a |
|---|
| 16 | 16 | | concrete plant that performs wet batching, dry batching, or central |
|---|
| 17 | 17 | | mixing. |
|---|
| 18 | 18 | | (b) The commission by rule shall prohibit the operation of a |
|---|
| 19 | 19 | | concrete batch plant operating under a standard permit issued under |
|---|
| 20 | 20 | | Section 382.05195 within 550 feet of a concrete crushing facility, |
|---|
| 21 | 21 | | a hot mix asphalt plant, or a second concrete batch plant operating |
|---|
| 22 | 22 | | under that standard permit, unless the first concrete batch plant |
|---|
| 23 | 23 | | was authorized to begin operations before September 1, 2025. |
|---|
| 24 | 24 | | (c) This subsection applies only to the renewal of an |
|---|
| 25 | 25 | | authorization to use a standard permit issued under Section |
|---|
| 26 | 26 | | 382.05195 for a concrete batch plant that was authorized to begin |
|---|
| 27 | 27 | | operations before September 1, 2025. After the renewal of the |
|---|
| 28 | 28 | | authorization, the commission shall prohibit the operation of the |
|---|
| 29 | 29 | | concrete batch plant at the same time as any of the following types |
|---|
| 30 | 30 | | of facilities located within 550 feet of the concrete batch plant: |
|---|
| 31 | 31 | | (1) a concrete crushing facility; |
|---|
| 32 | 32 | | (2) a hot mix asphalt plant; or |
|---|
| 33 | 33 | | (3) another concrete batch plant operating under a |
|---|
| 34 | 34 | | standard permit issued under Section 382.05195. |
|---|
| 35 | 35 | | (d) The measurement of distance for the purposes of this |
|---|
| 36 | 36 | | section must be taken from the point on the concrete batch plant |
|---|
| 37 | 37 | | that is nearest to the concrete crushing facility, hot mix asphalt |
|---|
| 38 | 38 | | plant, or other concrete batch plant toward the point on the |
|---|
| 39 | 39 | | concrete crushing facility, hot mix asphalt plant, or other |
|---|
| 40 | 40 | | concrete batch plant that is nearest the concrete batch plant. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2025. |
