11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 86.021, Local Government Code, is | |
13 | 13 | amended by adding Subsection (f) to read as follows: | |
14 | 14 | (f) A constable of a county with a population of more than | |
15 | 15 | four million may enforce an ordinance adopted by the governing body | |
16 | 16 | of a municipality if the municipality and the commissioners court | |
17 | 17 | of the county for which the constable serves have entered into a | |
18 | 18 | written agreement authorizing the constable to enforce the | |
19 | 19 | ordinance. The constable may only enforce an ordinance under this | |
20 | 20 | subsection within the portion of the municipality located in the | |
21 | 21 | county for which the constable serves. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2025. |
