| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter G, Chapter 27, Water Code, is amended |
|---|
| 14 | 14 | | by adding Section 27.1535 to read as follows: |
|---|
| 15 | 15 | | Sec. 27.1535. CERTAIN AUTHORIZATIONS PROHIBITED. (a) This |
|---|
| 16 | 16 | | section applies only to a Class V injection well located in any |
|---|
| 17 | 17 | | portion of the territory of a groundwater conservation district |
|---|
| 18 | 18 | | that is located wholly or partly in a county that: |
|---|
| 19 | 19 | | (1) has a population of more than 70,000 and less than |
|---|
| 20 | 20 | | 100,000 and contains a portion of the Colorado River; and |
|---|
| 21 | 21 | | (2) is adjacent to a county that has a population of |
|---|
| 22 | 22 | | one million or more. |
|---|
| 23 | 23 | | (b) The commission may not authorize the use of a Class V |
|---|
| 24 | 24 | | injection well for an aquifer storage and recovery project operated |
|---|
| 25 | 25 | | by a municipally owned utility that primarily provides water to a |
|---|
| 26 | 26 | | municipality that: |
|---|
| 27 | 27 | | (1) has a population of 750,000 or more; and |
|---|
| 28 | 28 | | (2) is located in a county adjacent to a county |
|---|
| 29 | 29 | | described by Subsection (a). |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2025. |
