77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on the authorization by the Texas
1010 Commission on Environmental Quality of the use of a Class V
1111 injection well for certain aquifer storage and recovery projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter G, Chapter 27, Water Code, is amended
1414 by adding Section 27.1535 to read as follows:
1515 Sec. 27.1535. CERTAIN AUTHORIZATIONS PROHIBITED. (a) This
1616 section applies only to a Class V injection well located in any
1717 portion of the territory of a groundwater conservation district
1818 that is located wholly or partly in a county that:
1919 (1) has a population of more than 70,000 and less than
2020 100,000 and contains a portion of the Colorado River; and
2121 (2) is adjacent to a county that has a population of
2222 one million or more.
2323 (b) The commission may not authorize the use of a Class V
2424 injection well for an aquifer storage and recovery project operated
2525 by a municipally owned utility that primarily provides water to a
2626 municipality that:
2727 (1) has a population of 750,000 or more; and
2828 (2) is located in a county adjacent to a county
2929 described by Subsection (a).
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2025.
