| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 301.003, Property Code, is amended by | |
| 13 | 13 | adding Subdivision (1-a) and amending Subdivision (8) to read as | |
| 14 | 14 | follows: | |
| 15 | 15 | (1-a) "Bona fide offer" means an offer made in good | |
| 16 | 16 | faith without deceitful motives and that is legally binding on the | |
| 17 | 17 | parties. The term includes a lump sum offer and an earnest money | |
| 18 | 18 | deposit. | |
| 19 | 19 | (8) "Dwelling" means any: | |
| 20 | 20 | (A) structure or part of a structure that is | |
| 21 | 21 | occupied as, or designed or intended for occupancy as, a residence | |
| 22 | 22 | by one or more families and has received a certificate of occupancy; | |
| 23 | 23 | or | |
| 24 | 24 | (B) vacant land that is offered for sale or lease | |
| 25 | 25 | for the construction or location of a structure or part of a | |
| 26 | 26 | structure described by Paragraph (A). | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
