88 AN ACT
99 relating to the establishment of an advisory committee to study and
1010 make recommendations on services provided to individuals with an
1111 intellectual or developmental disability.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 547, Government Code, as effective April
1414 1, 2025, is amended by adding Subchapter D-1 to read as follows:
1515 SUBCHAPTER D-1. INTELLECTUAL AND DEVELOPMENTAL DISABILITY
1616 SERVICES AND SUPPORTS ADVISORY COMMITTEE
1717 Sec. 547.0191. DEFINITION. In this subchapter, "advisory
1818 committee" means the intellectual and developmental disability
1919 services and supports advisory committee established under this
2020 subchapter.
2121 Sec. 547.0192. ESTABLISHMENT OF ADVISORY COMMITTEE. The
2222 commission shall establish the intellectual and developmental
2323 disability services and supports advisory committee to:
2424 (1) conduct a study identifying and evaluating gaps in
2525 access to acute and long-term care services and supports for
2626 individuals with an intellectual or developmental disability; and
2727 (2) provide to the legislature recommendations to
2828 address those gaps in access.
2929 Sec. 547.0193. ADVISORY COMMITTEE MEMBERS. (a) The
3030 executive commissioner shall appoint relevant stakeholders to
3131 serve as advisory committee members, including:
3232 (1) representatives of the commission;
3333 (2) representatives of the Department of State Health
3434 Services;
3535 (3) representatives of the Private Providers
3636 Association of Texas;
3737 (4) representatives of local intellectual and
3838 developmental disability authorities;
3939 (5) representatives of intellectual and developmental
4040 disability advocacy organizations;
4141 (6) persons with expertise on intellectual and
4242 developmental disability services and supports;
4343 (7) representatives of long-term services and
4444 supports providers;
4545 (8) representatives of managed care organizations;
4646 (9) individuals with an intellectual or developmental
4747 disability who receive services or supports; and
4848 (10) parents or other family members of individuals
4949 with an intellectual or developmental disability who receive
5050 services or supports.
5151 (b) The executive commissioner shall appoint an advisory
5252 committee member to serve as the advisory committee's presiding
5353 officer.
5454 (c) The executive commissioner shall fill a vacancy that
5555 occurs on the advisory committee in the same manner as the original
5656 appointment as soon as practicable but not later than the 60th day
5757 after the date the vacancy occurs.
5858 Sec. 547.0194. EXPENSES. An advisory committee member is
5959 not entitled to compensation but is entitled to reimbursement for
6060 actual and necessary expenses incurred in performing advisory
6161 committee duties. The advisory committee may accept gifts, grants,
6262 and donations to pay for those expenses.
6363 Sec. 547.0195. MEETINGS. (a) The advisory committee shall
6464 meet at least quarterly.
6565 (b) The advisory committee may conduct meetings in person or
6666 remotely.
6767 Sec. 547.0196. ADMINISTRATIVE SUPPORT. The commission
6868 shall provide administrative support for the advisory committee
6969 using existing resources.
7070 Sec. 547.0197. STUDY; BIENNIAL REPORT. (a) The advisory
7171 committee shall:
7272 (1) evaluate the adequacy of state and federal funding
7373 for acute and long-term care services and supports for individuals
7474 with an intellectual or developmental disability;
7575 (2) evaluate the financial sustainability of current
7676 service delivery models;
7777 (3) evaluate the availability and capacity of trained
7878 professionals, caregivers, and support staff necessary to deliver
7979 services for individuals with an intellectual or developmental
8080 disability;
8181 (4) identify best practices and innovative models used
8282 in and outside this state for services provided to individuals with
8383 an intellectual or developmental disability;
8484 (5) evaluate the quality of current services provided
8585 in this state to individuals with an intellectual or developmental
8686 disability;
8787 (6) evaluate the effectiveness of programs designed to
8888 promote health, education, employment, and community inclusion for
8989 individuals with an intellectual or developmental disability;
9090 (7) identify factors that contribute to mental health
9191 conditions affecting individuals with an intellectual or
9292 developmental disability;
9393 (8) evaluate public safety net services, including the
9494 role, functions, and capacity of local intellectual and
9595 developmental disability authorities to coordinate services and
9696 supports to meet the needs of individuals with an intellectual or
9797 developmental disability; and
9898 (9) review and identify areas for improvement to the
9999 Texas Statewide Intellectual and Developmental Disabilities
100100 Strategic Plan developed by the IDD Strategic Planning Group.
101101 (b) Not later than August 31 of each even-numbered year, the
102102 advisory committee shall prepare and submit to the legislature and
103103 each standing committee of the legislature with primary
104104 jurisdiction over intellectual and developmental disability issues
105105 a written report that includes:
106106 (1) a summary of the results of the advisory
107107 committee's findings under Subsection (a);
108108 (2) recommendations to address gaps in access to acute
109109 and long-term care services and supports for individuals with an
110110 intellectual or developmental disability;
111111 (3) recommendations for legislative or administrative
112112 action, including legislation or rules, to implement the advisory
113113 committee's recommendations;
114114 (4) a complete explanation of each of the advisory
115115 committee's recommendations; and
116116 (5) suggested timelines for implementing each of the
117117 advisory committee's recommendations.
118118 Sec. 547.0198. EXPIRATION. (a) Not later than December 1,
119119 2028, the commission shall prepare and submit to the legislature a
120120 report that contains a recommendation on whether the advisory
121121 committee should be continued or abolished.
122122 (b) The advisory committee is abolished and this subchapter
123123 expires September 1, 2029.
124124 SECTION 2. As soon as practicable after the effective date
125125 of this Act but not later than December 1, 2025, the executive
126126 commissioner of the Health and Human Services Commission shall
127127 appoint members to the intellectual and developmental disability
128128 services and supports advisory committee as required by Section
129129 547.0193, Government Code, as added by this Act.
130130 SECTION 3. This Act takes effect September 1, 2025.
