77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the expression of breast milk in public buildings and
1010 providing leave for state employees to donate breast milk.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 443, Government Code, is amended by
1313 adding Section 443.0134 to read as follows:
1414 Sec. 443.0134. PLACE TO EXPRESS BREAST MILK. The board
1515 shall provide a place in the Capitol, other than a bathroom, that is
1616 shielded from view and free from intrusion of any person where a
1717 member of the public or an employee can express breast milk.
1818 SECTION 2. Section 619.004, Government Code, is amended to
1919 read as follows:
2020 Sec. 619.004. PUBLIC EMPLOYER RESPONSIBILITIES. (a) A
2121 public employer shall:
2222 (1) provide a reasonable amount of break time for an
2323 employee to express breast milk each time the employee has need to
2424 express the milk; and
2525 (2) provide a place, other than a [multiple user]
2626 bathroom, that is shielded from view and free from intrusion from
2727 other employees and the public where the employee can express
2828 breast milk.
2929 (b) A public employer that engages in or contracts for the
3030 construction or renovation of any building regularly occupied by
3131 members of the public shall ensure the building includes a publicly
3232 accessible place, other than a bathroom, that is shielded from view
3333 and free from intrusion of another person where a member of the
3434 public can express breast milk.
3535 SECTION 3. Subchapter Z, Chapter 661, Government Code, is
3636 amended by adding Section 661.925 to read as follows:
3737 Sec. 661.925. LEAVE FOR BREAST MILK DONORS. (a) A state
3838 agency shall allow each agency employee sufficient time off,
3939 without a deduction in salary or accrued leave, to donate breast
4040 milk.
4141 (b) An employee may not receive time off under this section
4242 unless the employee obtains approval from the employee's supervisor
4343 before taking time off.
4444 (c) An employee may receive time off under this section once
4545 a month.
4646 SECTION 4. As soon as practicable after the effective date
4747 of this Act, the State Preservation Board shall establish a place in
4848 the Capitol for a person to express breast milk as required by
4949 Section 443.0134, Government Code, as added by this Act.
5050 SECTION 5. Section 619.004(b), Government Code, as added by
5151 this Act, applies only to the construction or renovation of a
5252 building described by that section that begins on or after the
5353 effective date of this Act.
5454 SECTION 6. This Act takes effect September 1, 2025.
