| 9 | 9 | | relating to the expression of breast milk in public buildings and |
|---|
| 10 | 10 | | providing leave for state employees to donate breast milk. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 443, Government Code, is amended by |
|---|
| 13 | 13 | | adding Section 443.0134 to read as follows: |
|---|
| 14 | 14 | | Sec. 443.0134. PLACE TO EXPRESS BREAST MILK. The board |
|---|
| 15 | 15 | | shall provide a place in the Capitol, other than a bathroom, that is |
|---|
| 16 | 16 | | shielded from view and free from intrusion of any person where a |
|---|
| 17 | 17 | | member of the public or an employee can express breast milk. |
|---|
| 18 | 18 | | SECTION 2. Section 619.004, Government Code, is amended to |
|---|
| 19 | 19 | | read as follows: |
|---|
| 20 | 20 | | Sec. 619.004. PUBLIC EMPLOYER RESPONSIBILITIES. (a) A |
|---|
| 21 | 21 | | public employer shall: |
|---|
| 22 | 22 | | (1) provide a reasonable amount of break time for an |
|---|
| 23 | 23 | | employee to express breast milk each time the employee has need to |
|---|
| 24 | 24 | | express the milk; and |
|---|
| 25 | 25 | | (2) provide a place, other than a [multiple user] |
|---|
| 26 | 26 | | bathroom, that is shielded from view and free from intrusion from |
|---|
| 27 | 27 | | other employees and the public where the employee can express |
|---|
| 28 | 28 | | breast milk. |
|---|
| 29 | 29 | | (b) A public employer that engages in or contracts for the |
|---|
| 30 | 30 | | construction or renovation of any building regularly occupied by |
|---|
| 31 | 31 | | members of the public shall ensure the building includes a publicly |
|---|
| 32 | 32 | | accessible place, other than a bathroom, that is shielded from view |
|---|
| 33 | 33 | | and free from intrusion of another person where a member of the |
|---|
| 34 | 34 | | public can express breast milk. |
|---|
| 35 | 35 | | SECTION 3. Subchapter Z, Chapter 661, Government Code, is |
|---|
| 36 | 36 | | amended by adding Section 661.925 to read as follows: |
|---|
| 37 | 37 | | Sec. 661.925. LEAVE FOR BREAST MILK DONORS. (a) A state |
|---|
| 38 | 38 | | agency shall allow each agency employee sufficient time off, |
|---|
| 39 | 39 | | without a deduction in salary or accrued leave, to donate breast |
|---|
| 40 | 40 | | milk. |
|---|
| 41 | 41 | | (b) An employee may not receive time off under this section |
|---|
| 42 | 42 | | unless the employee obtains approval from the employee's supervisor |
|---|
| 43 | 43 | | before taking time off. |
|---|
| 44 | 44 | | (c) An employee may receive time off under this section once |
|---|
| 45 | 45 | | a month. |
|---|
| 46 | 46 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 47 | 47 | | of this Act, the State Preservation Board shall establish a place in |
|---|
| 48 | 48 | | the Capitol for a person to express breast milk as required by |
|---|
| 49 | 49 | | Section 443.0134, Government Code, as added by this Act. |
|---|
| 50 | 50 | | SECTION 5. Section 619.004(b), Government Code, as added by |
|---|
| 51 | 51 | | this Act, applies only to the construction or renovation of a |
|---|
| 52 | 52 | | building described by that section that begins on or after the |
|---|
| 53 | 53 | | effective date of this Act. |
|---|
| 54 | 54 | | SECTION 6. This Act takes effect September 1, 2025. |
