77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of certain children of classroom
1010 teachers for enrollment in a free prekindergarten program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 29.153(b), Education Code, is amended to
1313 read as follows:
1414 (b) A child is eligible for enrollment in a prekindergarten
1515 class under this section if the child is at least three years of age
1616 and:
1717 (1) is unable to speak and comprehend the English
1818 language;
1919 (2) is educationally disadvantaged;
2020 (3) is homeless, regardless of the residence of the
2121 child, of either parent of the child, or of the child's guardian or
2222 other person having lawful control of the child;
2323 (4) is the child of an active duty member of the armed
2424 forces of the United States, including the state military forces or
2525 a reserve component of the armed forces, who is ordered to active
2626 duty by proper authority;
2727 (5) is the child of a member of the armed forces of the
2828 United States, including the state military forces or a reserve
2929 component of the armed forces, who was injured or killed while
3030 serving on active duty;
3131 (6) is or ever has been in:
3232 (A) the conservatorship of the Department of
3333 Family and Protective Services following an adversary hearing held
3434 as provided by Section 262.201, Family Code; or
3535 (B) foster care in another state or territory, if
3636 the child resides in this state; [or]
3737 (7) is the child of a person eligible for the Star of
3838 Texas Award as:
3939 (A) a peace officer under Section 3106.002,
4040 Government Code;
4141 (B) a firefighter under Section 3106.003,
4242 Government Code; or
4343 (C) an emergency medical first responder under
4444 Section 3106.004, Government Code; or
4545 (8) is the child of a person employed as a classroom
4646 teacher at a public primary or secondary school in this state.
4747 SECTION 2. This Act applies beginning with the 2025-2026
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2025.
