| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 38.042 to read as follows: |
|---|
| 13 | 13 | | Sec. 38.042. CUSTODIAN WORKLOAD POLICY. (a) The board of |
|---|
| 14 | 14 | | trustees of each school district shall adopt a policy regarding |
|---|
| 15 | 15 | | custodian workload for district facilities. The policy must |
|---|
| 16 | 16 | | establish benchmarks for the amount of square feet that may be |
|---|
| 17 | 17 | | assigned to a properly equipped school custodian for maintenance |
|---|
| 18 | 18 | | and custodial services during an eight-hour shift. |
|---|
| 19 | 19 | | (b) The board must provide benchmarks under Subsection (a) |
|---|
| 20 | 20 | | categorized by elementary, middle, and high school campuses, and |
|---|
| 21 | 21 | | other district facilities. |
|---|
| 22 | 22 | | (c) The school district shall post the policy adopted under |
|---|
| 23 | 23 | | this section on the school district's Internet website. |
|---|
| 24 | 24 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 25 | 25 | | school year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2025. |
