88 AN ACT
99 relating to the medical use of low-THC cannabis by patients with
1010 certain medical conditions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 169.001(3), Occupations Code, is amended
1313 to read as follows:
1414 (3) "Low-THC cannabis" means the plant Cannabis sativa
1515 L., and any part of that plant or any compound, manufacture, salt,
1616 derivative, mixture, preparation, resin, or oil of that plant that
1717 contains not more than 10 milligrams [one percent by weight] of
1818 tetrahydrocannabinols in each dosage unit.
1919 SECTION 2. Section 169.003, Occupations Code, is amended to
2020 read as follows:
2121 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. (a) A
2222 physician described by Section 169.002 may prescribe low-THC
2323 cannabis to a patient if:
2424 (1) the patient is a permanent resident of the state;
2525 (2) the physician complies with the registration
2626 requirements of Section 169.004; and
2727 (3) the physician certifies to the department that:
2828 (A) the patient is diagnosed with:
2929 (i) epilepsy;
3030 (ii) a seizure disorder;
3131 (iii) multiple sclerosis;
3232 (iv) spasticity;
3333 (v) amyotrophic lateral sclerosis;
3434 (vi) autism;
3535 (vii) cancer;
3636 (viii) an incurable neurodegenerative
3737 disease;
3838 (ix) post-traumatic stress disorder; [or]
3939 (x) a condition that causes chronic pain,
4040 for which a physician would otherwise prescribe an opioid;
4141 (xi) a medical condition that is approved
4242 for a research program under Subchapter F, Chapter 487, Health and
4343 Safety Code, and for which the patient is receiving treatment under
4444 that program; or
4545 (xii) a debilitating medical condition
4646 designated by the Department of State Health Services under
4747 Subsection (b); and
4848 (B) the physician determines the risk of the
4949 medical use of low-THC cannabis by the patient is reasonable in
5050 light of the potential benefit for the patient.
5151 (b) The Department of State Health Services by rule may
5252 designate debilitating medical conditions for which a physician may
5353 prescribe low-THC cannabis under this section.
5454 SECTION 3. This Act takes effect September 1, 2025.
