77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to eligibility for the exemption from ad valorem taxation
1010 of the residence homestead of the surviving spouse of certain first
1111 responders.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11.134(a)(1), Tax Code, is amended to
1414 read as follows:
1515 (1) "First responder" means:
1616 (A) an individual listed under Section 615.003,
1717 Government Code;
1818 (B) a special agent of United States Immigration
1919 and Customs Enforcement;
2020 (C) a customs and border protection officer or
2121 border patrol agent of United States Customs and Border Protection;
2222 or
2323 (D) an immigration enforcement agent or
2424 deportation officer of the United States Department of Homeland
2525 Security.
2626 SECTION 2. Section 11.134(b), Tax Code, is amended to read
2727 as follows:
2828 (b) The surviving spouse of a first responder who is killed
2929 or fatally injured in the line of duty is entitled to an exemption
3030 from taxation of the total appraised value of the surviving
3131 spouse's residence homestead if the surviving spouse has not
3232 remarried since the death of the first responder and:
3333 (1) in the case of the surviving spouse of a first
3434 responder described by Subsection (a)(1)(A), is an eligible
3535 survivor for purposes of Chapter 615, Government Code, as
3636 determined by the Employees Retirement System of Texas under that
3737 chapter; or [and]
3838 (2) in the case of the surviving spouse of a first
3939 responder described by Subsection (a)(1)(B), (C), or (D), was a
4040 resident of this state at the time of the first responder's death
4141 [has not remarried since the death of the first responder].
4242 SECTION 3. The change in law made by this Act applies only
4343 to a tax year beginning on or after January 1, 2026.
4444 SECTION 4. This Act takes effect January 1, 2026.
