77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study on the use of surplus government property to
1010 provide housing to veterans and low-income families.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "Department" means the Texas Department of Housing
1414 and Community Affairs.
1515 (2) "Low-income family" means a family earning not
1616 more than 80 percent of the area median income or applicable federal
1717 poverty line, as determined by the department under Section
1818 2306.123 or 2306.1231, Government Code.
1919 (3) "Surplus government property" means unused or
2020 underused federal, state, or local property, including real
2121 property, historic buildings, residential buildings, and
2222 commercial buildings.
2323 SECTION 2. STUDY. (a) The department shall conduct a study
2424 on the feasibility of using surplus government property to provide
2525 housing to veterans and low-income families.
2626 (b) In conducting the study under this section, the
2727 department:
2828 (1) shall:
2929 (A) evaluate the availability of surplus
3030 government property in this state and the feasibility of developing
3131 housing units on that property to provide housing to veterans and
3232 low-income families; and
3333 (B) identify potential funding sources to
3434 develop housing units on surplus government property, including:
3535 (i) federal historic tax credits;
3636 (ii) federal housing tax credits;
3737 (iii) corporate and private donations;
3838 (iv) other existing state and federal
3939 funding sources; and
4040 (v) proposed tenant rent payments; and
4141 (2) may consult with:
4242 (A) local housing authorities;
4343 (B) affordable housing developers; and
4444 (C) organizations and persons with appropriate
4545 and relevant expertise on the housing needs of veterans or
4646 low-income families.
4747 SECTION 3. REPORT. Not later than November 1, 2026, the
4848 department shall prepare and submit to the legislature a written
4949 report summarizing the results of the study conducted under this
5050 Act.
5151 SECTION 4. EXPIRATION. This Act expires September 1, 2027.
5252 SECTION 5. EFFECTIVE DATE. This Act takes effect September
5353 1, 2025.
