8	8		AN ACT
9	9		relating to the peace officer's notification of emergency detention
10	10		form for persons evidencing mental illness and retention of that
11	11		form.
12	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13		SECTION 1. The heading to Section 573.002, Health and
14	14		Safety Code, is amended to read as follows:
15	15		Sec. 573.002. PEACE OFFICER'S NOTIFICATION OF EMERGENCY
16	16		DETENTION.
17	17		SECTION 2. Section 573.002, Health and Safety Code, is
18	18		amended by amending Subsections (a), (b), (c), and (d) and adding
19	19		Subsection (d-1) to read as follows:
20	20		(a) A peace officer shall immediately file with a facility a
21	21		notification of emergency detention after transporting a person to
22	22		that facility in accordance with Section 573.001. Emergency
23	23		medical services personnel of an emergency medical services
24	24		provider who transport a person to a facility at the request of a
25	25		peace officer made in accordance with a memorandum of understanding
26	26		executed under Section 573.005 shall immediately file with the
27	27		facility the notification of emergency detention completed by the
28	28		peace officer who made the request.
29	29		(b) The notification of emergency detention must contain:
30	30		(1) a statement that the officer has reason to believe
31	31		and does believe that the person evidences mental illness;
32	32		(2) a statement that the officer has reason to believe
33	33		and does believe that the person evidences a substantial risk of
34	34		serious harm to the person or others;
35	35		(3) [a specific description of the risk of harm;
36	36		[(4)] a statement that the officer has reason to
37	37		believe and does believe that the risk of harm is imminent unless
38	38		the person is immediately restrained;
39	39		(4) [(5)] a statement that the officer's beliefs are
40	40		derived from specific recent behavior, overt acts, attempts, or
41	41		threats that were observed by or reliably reported to the officer;
42	42		(5) [(6)] a detailed description of the specific
43	43		behavior, acts, attempts, or threats; and
44	44		(6) [(7)] the name and relationship to the apprehended
45	45		person of any person who reported or observed the behavior, acts,
46	46		attempts, or threats.
47	47		(c) The facility where the person is detained shall include
48	48		in the detained person's clinical file the notification of
49	49		emergency detention described by this section.
50	50		(d) The peace officer shall provide the notification of

240	244		not require a peace officer or emergency medical services personnel
241	245		to execute any form other than this form as a predicate to accepting
242	246		for temporary admission a person detained by a peace officer under
243	247		Section 573.001, Health and Safety Code, and transported by the
244	248		officer under that section or by emergency medical services

258	256		SECTION 3. The changes in law made by this Act apply only to

263	261		effect for that purpose.
