88 AN ACT
99 relating to the creation of a list of priority facilities by
1010 electric utilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
1313 amended by adding Section 38.0725 to read as follows:
1414 Sec. 38.0725. LIST OF PRIORITY FACILITIES. (a) In this
1515 section, "priority facility" means:
1616 (1) a facility listed in Section 38.072(b); or
1717 (2) a facility for which electric service is
1818 considered crucial for the protection or maintenance of public
19- safety, including:
20- (A) a hospital;
21- (B) a police station;
22- (C) a fire station;
23- (D) a critical water or wastewater facility; and
24- (E) a confinement facility operated by or under a
25- contract with any division of the Texas Department of Criminal
26- Justice.
27- (b) An electric utility shall maintain a list of priority
28- facilities in the utility's retail service area.
29- (c) An electric utility shall provide on the utility's
19+ safety.
20+ (b) The commission by rule shall adopt criteria for
21+ determining whether a facility is a facility for which electric
22+ service is considered crucial for the protection or maintenance of
23+ public safety under Subsection (a)(2). The criteria must
24+ automatically include the following types of facilities:
25+ hospitals, police stations, fire stations, and critical water and
26+ wastewater facilities.
27+ (c) An electric utility shall maintain a list of priority
28+ facilities in the utility's service area.
29+ (d) An electric utility shall provide on the utility's
3030 Internet website a mechanism for a facility to request that the
3131 utility add the facility to the priority facility list. The
3232 electric utility shall add the requested facility to the list only
33- if the facility is a priority facility.
34- (d) On request from a facility, an electric utility shall
33+ if the facility is a priority facility according to the criteria
34+ adopted by the commission under Subsection (b).
35+ (e) On request from a facility, an electric utility shall
3536 disclose to the facility not later than the 14th day after the date
36- the utility receives the request whether the facility is on the
37- priority facility list.
38- (e) Notwithstanding any other law, on a declaration of a
39- natural disaster or other emergency by the governor affecting the
40- service area of the electric utility, the utility shall provide the
41- list of priority facilities to the Texas Division of Emergency
42- Management.
43- (f) A priority facility list submitted to the Texas Division
44- of Emergency Management under this section is confidential and not
45- subject to disclosure under Chapter 552, Government Code.
