| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter B, Chapter 372, Transportation Code, | |
| 13 | 13 | is amended by adding Section 372.060 to read as follows: | |
| 14 | 14 | Sec. 372.060. VOTER APPROVAL OF TOLL PROJECT REQUIRED; | |
| 15 | 15 | ELECTION. (a) Notwithstanding any other provision of law, a toll | |
| 16 | 16 | project entity may not construct a toll project unless the project | |
| 17 | 17 | is approved by a majority of voters voting at an election held for | |
| 18 | 18 | that purpose in each county in which a portion of the project is to | |
| 19 | 19 | be located. | |
| 20 | 20 | (b) The commissioners court of a county may order an | |
| 21 | 21 | election under this section. The order calling the election must | |
| 22 | 22 | state: | |
| 23 | 23 | (1) the hours during which the polls will be open; | |
| 24 | 24 | (2) the location of the polling places; and | |
| 25 | 25 | (3) the location of the toll project to be approved. | |
| 26 | 26 | (c) At an election to approve a toll project, the ballot | |
| 27 | 27 | must be printed to provide for voting for or against the approval of | |
| 28 | 28 | the toll project. | |
| 29 | 29 | SECTION 2. Section 372.060, Transportation Code, as added | |
| 30 | 30 | by this Act, applies only to a toll project for which a contract for | |
| 31 | 31 | financing or construction is entered into on or after the effective | |
| 32 | 32 | date of this Act. | |
| 33 | 33 | SECTION 3. This Act takes effect September 1, 2025. |
